3. ORAL COMMUNICATIONS
A~ this time, members of the audience are permitted to address the City Council on any item which is not
the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not
sufficient time to address their concern, that person should arrange with the City Manager to have their
particular concern placed on the agenda for a future meeting.
3.1 Proclamation honoring the efforts and deeds of the Honorable Dr. Aristides de Sousa Mendes do
Amaral e Abranches
4. CONSENT CALENDAR
Consent Calendar items are typically of a non-controversial nature and are considered for approval by
the City Council with one single action.
Members of the audience who would like an item removed from the consent calendar for purpose of public
input may request the City Council to remove the item from the consent calendar. The request may be
made at the time that the Mayor asks the audience members if there is anyone interested in removing an
item from the Consent Calendar.
4.1 Minutes of Regular Meeting of December 8, 1986
STAFF RECOMMENDATION: Approve
4.2 Request for Variance to Sections 508 and 3804 of the Uniform Building Code
Rafanelli & Nahas propose to construct 8 3-story buildings. The applicants propose to
utilize the provisions of Section 508 requesting to omit 3 sprinkler heads in each unit.
The City Council at its December 8, 1986 meeting granted the variance with the exception
that sprinklers shall be located in all indoor areas and shall not be required in outside
patio areas under the patio deck.
STAFF RECOMMENDATION: Adopt Resolution granting request.
4.3 Claim submitted December 1, 1986 by George Filstead
This claim alleges damages against the City of Dublin and involves Alameda County Sheriff's
Department personnel. Pursuant to our Police Services Agreement with Alameda County, the
County handles all claims related to contract services provided to the City of Dublin. The
Alameda County Risk Manager has been advised of the claim.
STAFF RECOMMENDATION: Deny claim and direct Staff to notify claimant.
4.4 Annual Statement of Investment Policy
Section 53646 of the Government Code requires that the City Treasurer or Chief Fiscal
Officer annually render to the City Council a Statement of Investment Policy. This year,
the Treasurer is changing both the method of approval as well as some of the policies.
STAFF RECOMMENDATION: Adopt REsolution of Investment Policy for 1987
4.5 Participation in NORCAL Employment Relations Training Consortium (NERTC)
The City of Concord is attempting to organize an Employment Training consortium with the
intent being to provide quality training seminars on issues related to employment. A
proposed agenda for the first year of operation would include topics which deal with
relevant issues for all agencies. The cost of participating will be divided evenly among
the member agencies. Seven cities have committed thus far, which would mean that Dublin's
membership cost should not exceed $1,875.
STAFF RECOMMENDATION: Authorize City to become a participant and approve an additional
appropriation from the Contingent Reserve to the City Manager Training Account in the amount of
$1,875.
4.6 Final Acceptance of Contract 86-5 - Street Slurry Seal Program
The City Engineer has reviewed the work on this project and determined that it is in
accordance with the approved plans, specifications and modifications.
STAFF RECOMMENDATION: Accept improvements under Contract 86-5; authorize retention payment to
Valley slurry Seal in the amount of $4,883.37; approve budget transfer of $5,410 from Contingent
Reserve to Street Maintenance Budget.
4.7 Report from City Manager regarding Downtowns Improvement Study Committee
According to a review of the minutes of the City Council meeting of April 8, 1985, it has
been determined that the City Council intended to disband the Downtown Improvement Study
Commitee by November, 1986.
STAFF RECOMMENDATION: Approve extension of Downtown Improvement Study Committee to May 1, 1987
4.8 Request to enter negotiations for sale of surplus property - The Fishery
The developers of The Fishery Restaurant on San Ramon Road are requesting to purchase excess
right-of-way at the front of their property.
STAFF RECOMMENDATION: Authorize Staff to enter negotiations and adopt Resolution Establishing
Surplus Property.
4.9 Purchase of Real Property along Dougherty Road at the Southern Pacific Railroad Right-of-Way
The City of Dublin requires right-of-way at the Southern Pacific corridor for the future
widening of Dougherty Road. Southern Pacific Transportation Company has agreed on the
City's offer to purchase this right-of-way for a sum of $120,000.
STAFF RECOMMENDATION: Adopt Resolution approving purchase and approve budget transfer of $9,300
from Reserve.
4.10 Final Acceptance - Contract 86-1 - Village Parkway Landscaping
The City Engineer has reviewed the work on the project and determined that it is in
accordance with the approved plans, specifications and modifications.
STAFF RECOMMENDATION: Accept improvements as being complete and release certificate of deposit
used in lieu of retention.
4.11 ABAG Pilot Household Hazardous Waste collection Program
ABAG is organizing a household hazardous waste collection day for cities in Alameda County.
The proposed program involves a single collection day for the Cities of Dublin, Livermore
and Pleasanton. ABAG will be providing an initial $10,000 to start the program, however,
the supplemental financing mechanism has not been determined.
STAFF RECOMMENDATION: Approve program in concept and direct Staff to evaluate funding options.
4.12 Acceptance of Contr 85-7 San Ramon Rd/San Ramon Vly Blvd/Alcosta Blvd Trfc Sgnl Improvmt proj
The City Engineer has reviewed the work on the project and determined that it is in
accordance with the approved plans, specifications and modifications.
STAFF RECOMMENDATION: Accept improvements; authorize retention payment to Hess Construction in
amount of $33,109.67; authorize an additional appropriation in amount of $43,506.05 from
Capital Reserve for authorized projects.
4.13 paratransit Services - 1986-87 Budget Modification
The 3 City JPA which includes Dublin Danville and San Ramon was not billed for 3 paratransit
vans as was anticipated in 1985/86. The City of Dublin is now in receipt of a bill for its
portion of the $3,921 commitment.
STAFF RECOMMENDATION: Authorize budget transfer of $3,921 from Contingent Reserve
4.14 Resolution establishing rules for the conduct of meetings of the Dublin City Council
In February 1982, the City Council established rules for the conduct of Council meetings.
Recent revisions to the Ralph M. Brown Act which become effective January 1, 1987,
necessitate the revision of the City Council's existing rules.
STAFF RECOMMENDATION: Adopt Resolution

b. PUBLIC HEARING
6.1 Ordinance Regulating the Sale to, Use by, or Possession by any Minor of Dangerous Weapons
This ordinance, which was introduced at the December 8, 1986 Council meeting provides for
the revision of Title 4, Chapter 1, Article 6 of the Alameda County Code which the City
adopted by Ordinance No. 13-82. This ordinance regulates the sale to, use by or possession
by any minors of dangerous weapons.
STAFF RECO~ll1ENDATION: Conduct public hearing; waive reading and adopt ordinance
6.2 Ordinance Establishing Title I of the Dublin Municipal Code (General Provisions)
This ordinance, which was introduced at the December 8, 1986 Council meeting is part of the
comprehensive revision of the City's ordinances and development of a Municipal Code. The
ordinance establishes definitions for words which will be used throughout the Municipal
Code; penalty provisions for violation of any provision of the Municipal Code; an appeal
process; a severability clause which would apply to all ordinances adopted and included in
the Code; and a 90 day statute of limitations for filing a writ of mandate to challenge any
administrative action taken by the Councilor a Commission.
STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance
6.3 Ordinance Regulating Private Patrol Operators
This ordinance, which was introduced at the December 8, 1986 Council meeting provides for
the revision of the provisions of Chapter 7 of Title 2 of the Alameda County Code, which the
City adopted by Ordinance No. 13-82. This ordinance requires a Private Patrol Operator to
conform with State Law; to register with the Dublin Police Department; and to receive
approval. from the Police Department regarding the uniform to be used by the Operator.
STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance
6.4 Ordinance Regulating Fortunetelling for Pay
This ordinance, which was introduced at the December 8, 1986 Council meeting makes it
unlawful for a person to engage in the business of fortunetelling within the City without
first obtaining a permit from the Chief of Police.
STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance
6.5 Ordinance Establishing a Street Address Numbering System
This ordinance is part of the program to incorporate provisions of the County ordinances
into the proposed Municipal Code. In 1959, Alameda County adopted two grid systems for
numbering the entire County. The provisions of this ordinance are essentially the same as
the County ordinance.
STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance.
6.6 Ordianance Requiring the Enclosure of Swimming Pools
This ordinance is part of the program to incorporate provisions of the County ordinances
into the proposed Municipal Code. The ordinance requires swimming pools to be enclosed by a
fence or a fence and portions of the building.
STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance.
6.7 Ordianance Relating to Auctioneers
This ordinance is part of the program to incorporate provisions of the County ordinances
into the proposed Municipal Code. This ordiannce does nothing more than require Auctioneers
to comply with the provisions of State Law and the City's Zoning Ordinance.
STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance.
6.8 Ordiannce Regulating Massage Establishments and Massage Services
This ordinance is part of the program to incorporate provisions of the County ordinances
into the Municipal Code. The ordinance regulates massage establishments and services.
STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance.
