Pursuant to Alameda County Health Officer Order No. 21-03, members of the public attending the meeting must wear a face covering over the nose and mouth at all times while indoors, even while speaking at the podium. Additional Meeting Procedures Available During the COVID-19 Pandemic This City Council meeting will be broadcast live on Comcast T.V. channel 28 beginning at 7:00 p.m. This meeting will also be livestreamed at www.tv28live.org and on the City’s website at: https://dublin.ca.gov/1604/Meetings-Agendas-Minutes- Video-on-Demand Members of the public who wish to participate in the meeting electronically have the option of giving public comment via Zoom, subject to the following procedures:  Fill out an online speaker slip available at www.dublin.ca.gov. The speaker slip will be made available at 10:00 a.m. on Tuesday, December 7, 2021. Upon submission, you will receive Zoom link information from the City Clerk. Speakers slips will be accepted until the staff presentation on an agenda item ends, or until the public comment period on non-agenda items is closed.  Once connected to the Zoom platform using the Zoom link information from the City Clerk, the public speaker will be added to the Zoom webinar as an attendee and muted. The speaker will be able to observe the meeting from the Zoom platform.  When the agenda item upon which the individual would like to comment is addressed, the City Clerk will announce the speaker in the meeting when it is their time to give public comment. ORAL COMMUNICATIONS 3.1 Presentation of Banners to 2021 Military Banner Program Participants The City Council will present the 2021 Military Banner Program participants with their individual banners. The Military Banner Program honors active-duty military personnel and veterans that reside in Dublin, have immediate family residing in Dublin, or have had a long-term, positive impact on the Dublin community. STAFF RECOMMENDATION: Present individual banners to Military Banner Program participants (honorees or banner sponsors). 3.2 Recognition of 2021 Inside Dublin Participants The City Council will recognize the 2021 Inside Dublin participants. STAFF RECOMMENDATION: Recognize the 2021 Inside Dublin Participants 3.3 Employee Introduction New City of Dublin Staff member, Judy Miller, Management Analyst II with Parks and Community Services, will be introduced. STAFF RECOMMENDATION: Welcome the City of Dublin Staff member. December 07, 2021 Dublin City Council Regular Meeting Agenda 3 3.4 Public Comment At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council ag enda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Approval of the November 16, 2021 Regular City Council Meeting Minutes The City Council will consider approval of the minutes of the November 16, 2021 Regular City Council Meeting. STAFF RECOMMENDATION: Approve the minutes of the November 16, 2021 Regular City Council Meetings. 4.2 Third Amendment to Agreement with Urban Field Studio for Architectural Design Services for Downtown Dublin The City Council will consider a third amendment to the Consultant Services Agreement between the City of Dublin and Urban Field Studio. Urban Field Studio is currently providing architectural design services for Downtown Dublin. STAFF RECOMMENDATION: Adopt the Resolution Approving a Third Amendment to the Consultant Services Agreement Between the City of Dublin and Urban Field Studio. 4.3 Annual Report of Developer Impact Fee Funds Deposits: Pursuant to Government Code Sections 66002, 66006 and 66008 (AB 1600) State law requires the City to review and report on an annual basis the status of Development fees collected to finance public improvements. The report covers activity which occurred in these funds during Fiscal Year 2020-21. The analysis has determined that all funds held for more than five years are necessary to complete identified projects. STAFF RECOMMENDATION: Accept the report and adopt the Resolution Making Findings Regarding Unexpended Traffic Impact Fees for Fiscal Year 2020-21. 4.4 Accessory Dwelling Unit Permit Fee Waivers The City Council will consider adopting changes to the Master Fee Schedule pertaining to permit fee waivers to facilitate the production of Accessory Dwelling Units (ADUs) throughout the community for a period of five years. STAFF RECOMMENDATION: Adopt the Resolution Amending the Master Fee Schedule to Waive Certain City Permit Fees for Accessory Dwelling Units (ADUs) Less Than 750 Square Feet and ADUs 750 Square Feet or Larger that are Deed-Restricted as Lower-Income Units. December 07, 2021 Dublin City Council Regular Meeting Agenda 4 4.5 Contract Instructor Services Agreement with North American Activities, LLC dba Kidz Love Soccer The City Council will consider approval of a contract instructor services agreement with North American Activities, LLC dba Kidz Love Soccer, for recreational services (soccer instruction), for a term beginning on January 1, 2022 and ending on June 30, 2023. STAFF RECOMMENDATION: Adopt the Resolution Approving a Contract Instructor Services Agreement with North American Activities, LLC dba Kidz Love Soccer for Recreation Services. 4.6 Second Reading of Ordinance Opting in to the Alameda County Waste Management Authority Organics Reduction and Recycling Ordinance and Amending Chapter 5.32 of the Dublin Municipal Code The City Council will consider adopting an Ordinance Opting in to the Alameda County Waste Management Authority Organics Reduction and Recycling Ordinance (ORRO) and Amending Chapter 5.32 of the Dublin Municipal Code. The first reading of this Ordinance was held at the November 16, 2021 Regular City Council Meeting. STAFF RECOMMENDATION: Waive the second reading and adopt the Ordinance Opting in to the Alameda County Waste Management Authority Organics Reduction and Recycling Ordinance and Amending Chapter 5.32 of the Dublin Municipal Code. 4.7 Filing of an Application for State of California Local Assistance Specified Grant Funds for Iron Horse Nature Park and Open Space The City Council will consider approving the filing of an application for the State of California Local Assistance Specified Grant Funding for the Iron Horse Nature Park and Open Space Capital Improvement Project. The City was notified that it has been awarded these funds and must complete this step to proceed in the grant process. STAFF RECOMMENDATION: Adopt the Resolution Approving the Filing of an Application for State of California Specified Grant Funds for the Iron Horse Nature Park and Open Space Capital Improvement Project. 4.8 First Amendment to Concessions Facilities Agreement with Pacific Coast Entertainment Group LLC DBA Rebel Kitchen & Libations The City Council will consider approving a first amendment to the Concession Facilities Agreement between the City of Dublin and Pacific Coast Entertainment Group LLC DBA Rebel Kitchen & Libations for operation of concession services at The Wave Waterpark for the 2022 and 2023 waterpark seasons. STAFF RECOMMENDATION: Adopt the Resolution Approving a First Amendment to the Concession Facilities Agreement with Pacific Coast Entertainment Group LLC DBA Rebel Kitchen & Libations. 4.9 Regional Street Residential Project Community Benefit Program Agreement (PLPA- 2021-00035) The City Council will consider approval of a Community Benefit Program Agreement with Eden Housing’s controlled affiliate Corona/Ely Ranch, Inc. for the development of a 113- unit affordable housing project on a 1.33-acre site located at 6541-6543 Regional Street west of the West Dublin/Pleasanton BART Station within the Downtown Dublin Specific Plan Transit-Oriented District. A Community Benefit Program Agreement is required to December 07, 2021 Dublin City Council Regular Meeting Agenda 5 allocate units from the Downtown Dublin Specific Plan Development Pool. The Site Development Review Permit for the project was approved by the Planning Commission on November 23, 2021, and that approval is contingent upon approval of a Community Benefit Program Agreement by the City Council. STAFF RECOMMENDATION: Adopt the Resolution Approving a Community Benefit Program Agreement Between the City of Dublin and Corona/Ely Ranch, Inc. 4.10 First Amendment to the Grant Agreement for Open Heart Kitchen Facility The City Council will consider approving the First Amendment to the Grant Agreement with TriValley BMR, LLC to add $300,000 (for a total of $630,000) of Community Development Block Grant funding to construct a new kitchen facility for Open Heart Kitchen as part of a larger 24-unit supportive housing development known as Vineyard 2.0 located in Livermore and providing services to Tri-Valley residents. STAFF RECOMMENDATION: Adopt the Resolution Approving the First Amendment to the Grant Agreement with TriValley BMR, LLC to Provide Additional Funding for use of CDBG Capital Project Funds. 4.11 Agreement with Matrix Consulting Group for Staffing Analysis and Optimization Planning Services for the Public Works Department The City Council will consider an agreement with Matrix Consulting Group for staffing analysis and optimization planning for the Public Works Department. STAFF RECOMMENDATION: Adopt the Resolution Approving an Agreement with Matrix Consulting Group for Staffing Analysis and Optimization Planning Services for the Public Works Department. 4.12 Ordinance Amending Chapter 2.12 (Planning Commission) of the Dublin Municipal Code At its October 19, 2021 Special Meeting, the City Council directed Staff to prepare a resolution amending the Rules for the Conduct of Meetings of the City Council and to update the teleconference section in Chapter 2.12 of the Municipal Code relating to the Planning Commission. The first reading of this Ordinance was held at the November 16, 2021 Regular City Council Meeting. STAFF RECOMMENDATION: Waive the second reading and adopt the Ordinance Amending Chapter 2.12 (Planning Commission) of the Dublin Municipal Code to Allow Up to Two Commissioners to Participate via Remote Attendance and Allow Video Attendance Remotely. 4.13 Mayor’s Recommendation for Appointment to the Senior Center Advisory Committee Unscheduled Alternate Vacancy The City Council will consider the Mayor’s recommendation for appointment to fill an unscheduled alternate vacancy on the Senior Center Advisory Committee. STAFF RECOMMENDATION: Confirm the Mayor’s recommendation to appoint Steve Kau as an alternate to the Senior Center Advisory Committee for the remainder of a term ending December 2022. 5. PUBLIC HEARING 6.1 East Ranch (PLPA-2020-00028) The City Council will consider a proposal to develop a 165.5-acre site with a 573-unit residential project consisting of six neighborhoods, two neighborhood parks totaling 11.5 acres, and a two-acre Public/Semi-Public site reserved for affordable housing located on Croak Road east of Fallon Road. The project site straddles existing Croak Road with Jordan Ranch to the west, Positano to the north and undeveloped land to the east and south with the Interstate 580 beyond. Requested approvals include a Planned Development Zoning Stage 2 Development Plan, Vesting Tentative Tract Map No. 8563 and a Heritage Tree Removal Permit. The City Council will also consider an exemption from the California Environmental Quality Act (CEQA). STAFF RECOMMENDATION: Conduct a public hearing, deliberate and take the following actions: a) find the project exempt from CEQA pursuant to Government Code Section 65457 and waive the reading and INTRODUCE an Ordinance Amending the Zoning Map and Approving a Planned Development Zoning District with a Stage 2 Development Plan and CEQA Findings for the East Ranch Project; and b) adopt the Resolution Approving Vesting Tentative Tract Map No. 8563 and a Heritage Tree Removal Permit Related to the East Ranch Project. 7. UNFINISHED BUSINESS – None. 8. NEW BUSINESS 8.1 Selection of Vice Mayor The City Council’s policy is to select, in December of each year, a member of the City Council to serve as Vice Mayor for a period of one-year. In the absence of the Mayor, the Vice Mayor would become Mayor Pro Tempore and would assume the temporary responsibilities of the Mayor. STAFF RECOMMENDATION: Determine who shall serve as Vice Mayor for a one-year period, December 2021 – December 2022. 9. OTHER BUSINESS Brief information only reports from City Council and/or Staff, including committee reports and reports by City Council related to meetings attended at City expense (AB1234). 10.
