HomeMy WebLinkAboutReso 154-01 FinalMap Tr 7181RESOLUTION NO. 154 - 01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING THE FINAL MAP FOR TRACT 7181 (SCARLETT HOMES LLC, A CALIFORNIA LIMITED LIABILITY COMPANY) WHEREAS, the Final Map for Tract 7181, in the incorporated territory of the City of Dublin, State of California, has been presented to this City Council for approval, all in accordance with the provisions of the Subdivision Map Act of the State of California and the City of Dublin Municipal Code; and WHEREAS, the subdivider, Scarlett Homes LLC, a California Limited Liability Company, has dedicated to the public on the Final Map for Tract 7181 the rights-of-way required for the widening of Dougherty Road, and the extensions of Scarlett Drive and Houston Place, along with a Public Services Easement (P.S.E.) and an Emergency Vehicle Access Easement (E.V.A.E.), all in accordance with the Vesting Tentative Map approved by the Planning Commission via Resolution 00-46; and WHEREAS, Scarlett Homes LLC has executed and filed with the City of Dublin an Improvement Agreement to improve Dougherty Road, Scarlett Drive, Houston Place, and required site improvements in accordance with the Conditions of Approval for the Vesting Tentative Map, and in accordance with the improvement plans and the specifications attached thereto; and WHEREAS, said Improvement Agreement is secured by two bonds furnished by Travelers Casualty and Surety Company of America in the amounts of $1,812,625.00 for on-site improvements (Bond No. 103323863) and $1,319,875.00 for off-site improvements (Bond No. 103323861) for a total bond amount of $3,132,500.00, conditioned upon faithful performance of said Agreement; and WHEREAS, said Improvement Agreement is secured by two bonds furnished by Travelers Casualty and Surety Company of America in the amounts of $1,812,625.00 for on-site improvements (Bond No. 103323863) and $1,319,875.00 for off-site improvements (Bond No. 103323861) for a total bond amount of $3,132,500.00, conditioned upon payment for labor performed or material furnished under the terms of said Agreement; NOW, THEREFORE, BE IT RESOLVED that said Improvement Agreement and bonds are hereby approved, and the Mayor is hereby authorized by the City Council to execute the Improvement Agreement. BE IT FURTHER RESOLVED that the Final Map for Tract 7181 is hereby approved, and the rights to areas marked as Dougherty Road, Scarlett Drive, Houston Place, and those strips of lands marked Public Service Easement (P. S.E.), and Emergency Vehicle Access Easement (E.V.A.E.) as offered for dedication to the public in conformity with the terms of dedication are hereby accepted, subject to Page 1 improvement, and the Clerk of this City Council is hereby directed to transmit said Map to the County Recorder for filing. PASSED, APPROVED AND ADOPTED this 21st day of August, 2001.
