No. 18-22, Item 4.3, Adopted 03/01/2022 Page 1 of 2 RESOLUTION NO. 18 - 22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING THE PLANS AND SPECIFICATIONS, WAIVING A MINOR BID IRREGULARITY, AND AWARDING A CONTRACT TO GOODFELLOW SEQUOIA JOINT VENTURE FOR THE IRON HORSE TRAIL BRIDGE AT DUBLIN BOULEVARD PROJECT, CIP NO. ST0118 WHEREAS, on February 20, 2018, the City Council adopted Resolution No. 15-18, approving a new Capital Improvement Program Project , the Iron Horse Trail Bridge at Dublin Boulevard (“Project”) and approving a Consulting Services Agreement with Mark Thomas & Company, Inc. for the final design phase for the Project; and WHEREAS, the design team has completed the plans and specifications for Project , which will construct a pedestrian and bicycle bridge structure, support foundations, and graduated ramps facilitating connection to the existing at-grade trail on the north and south sides of Dublin Boulevard at the intersection of Scarlett Drive; and WHEREAS, the City of Dublin did, on January 20, 2022, publicly open, examine, and declare all sealed bids for doing the work described in the approved Plans and Specification s for the Project, which Plans and Specification s are hereby expressly referred to for a description of said work and for all particulars relative to the proceedings under the request for bids; and WHEREAS, Goodfellow Sequoia Joint Venture’s bid contained minor bid irregularities in that there was a clerical error in the entry of Alternate Item 3 which is not considered as a basis of the lowest bid price nor are any alternate bid items being awarded, and the base contract total was written in numbers only, not spelled out in words , but consistent with the summation of the base bid extensions, and the Public Contract Code and the City’s bid documents authorize the City to waive any minor irregularity and proceed with the award of the contract; and WHEREAS, said bids were submitted to City Staff and that Goodfellow Sequoia Joint Venture was determined to be the lowest responsive and responsible bidder for doing said work. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby approves the Plans and Specifications for the Project. BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby waive the minor bid irregularities since the clerical errors do not change the lowest bid price on the Base Contract. BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby award the Contract for the Project to the lowest responsive bidder, Goodfellow Sequoia Joint Venture, at a bid of $10,202,650.80, the particulars of which bids are on file in the Office of the Public Works Director. BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby authorize the City Manager or designee to approve the Project Contract Change Orders based on the appropriated funds designated for the Project up to the contingency amount of $1,020,000. No. 18-21, Item 4.3, Adopted 03/01/2022 Page 2 of 2 BE IT FURTHER RESOLVED that the City Manager or designee is authorized to execute the Construction Agreement with Goodfellow Sequoia Joint Venture and make any necessary, non-substantive changes to carry out the intent of this Resolution.
