Facts and circumstances: Letter from Kevin Shenkman to City Clerk, dated

REGULAR MEETING
A regular meeting of the Dublin City Council was held on Tuesday, February 15, 2022,
in the City Council Chamber. The meeting was called to order at 7:02 PM., by Mayor
Hernandez.
1) CALL TO ORDER AND PLEDGE OF ALLEGIANCE

Mayor Hernandez invited Chief Holmes to share comments with the City Council about
fallen Dublin Police Deputy Aubrey Phillips.
2) REPORT ON CLOSED SESSION
Mayor Hernandez reported there was no reportable action.

3) ORAL COMMUNICATIONS
3.1) Employee Introductions
The City Council welcomed the new City of Dublin Staff members, Sarah
Monnastes, Human Resources Director and Oliver Castillo, Assistant Civil
Engineer with Public Works.
3.2) St. Patrick’s Day Celebration Preview
The City Council received a presentation that previews the annual St. Patrick’s
Day Celebration which will be held the weekend of March 11-13, 2022, including
protocols related to the COVID-19 pandemic.
3.3) Public Comment
No public comment was provided.
4) CONSENT CALENDAR
The City Council pulled item 4.3 for further discussion.
4.1) Approved the minutes of the February 1, 2022 Regular City Council Meeting and
February 5, 2022 Special City Council Meeting.
4.2) Adopted Resolution No. 12-22 titled, “Approving a Public Art Agreement with
Romo Studios for a Public Art Project at Heritage Park” and Resolution No. 13-22
titled, “Approving a Public Art Agreement with Brian Keith for a Public Art
Project at Heritage Park,” and approved the budget change.”
4.4) Received the Payment Issuance Report and Electronic Funds Transfers showing
a listing of payments issued from January 1, 2022 - January 31, 2022 totaling
$13,690,767.41.
On motion by Vice Mayor Josey, seconded by Mayor Hernandez, and by
unanimous vote the City Council adopted the remaining Consent Calendar
items.

4.3) Receive the City Treasurer's Informational Report of Investments for the
Quarter Ending December 31, 2021
Item 4.3 was pulled by Councilmember McCorriston for further discussion.
The Councilmembers asked clarifying questions of Bill Dennehy with Chandler
Asset Management.
On motion by Councilmember McCorriston, seconded by Vice Mayor Josey, and
by unanimous vote the City Council adopted Consent Calendar item 4.3.

5) WRITTEN COMMUNICATION – None.
6) PUBLIC HEARING
6.1 Fallon East General Plan and Eastern Dublin Specific Plan Amendment
(PLPA-2021-00009)
The City Council received a presentation on a General Plan and Eastern Dublin
Specific Plan Amendment for approximately 73 acres east of Fallon Road on the
GH PacVest and Alameda properties.
Mayor Hernandez opened the public hearing.
There being no public comment, Mayor Hernandez closed the public hearing.
On motion by Vice Mayor Josey, seconded by Councilmember McCorriston, and
by unanimous vote, the City Council adopted Resolution No. 14-22 titled,
“Approving an Addendum to the Eastern Dublin Specific Plan Environmental
Impact Reports and Approving the General Plan and Eastern Dublin Specific Plan
Amendment for 72.1 Acres of the GH PacVest Property and the 1.25-Acre Alameda
Property.”

6.2 Citywide Multi- Family Objective Design Standards, Zoning Ordinance
Amendments, and Master Fee Schedule Amendments (PLPA-2022-00002)
The City Council received a presentation regarding the Citywide Multi-Family
(MF) Objective Design Standards (ODS) and companion amendments to Title 8
(Zoning) of the Dublin Municipal Code and amendments to the Master Fee
Schedule to establish a fee for Zoning Clearances for Housing Projects Eligible
for Streamlined Approval.
Mayor Hernandez opened the public hearing.
There being no public comment, Mayor Hernandez closed the public hearing.
On motion by Councilmember Kumagai, seconded by Vice Mayor Josey, and by
unanimous vote, the City Council waived the reading and INTRODUCED the
Ordinance approving the Citywide Multi-Family Objective Design Standards and
amendments to Dublin Municipal Code Chapter 8.36 (Development Regulations),
Chapter 8.104 (Site Development Review), and Chapter 8.116 (Zoning Clearance),
including edits to standa 2.6B, 2.6C, and 3.8A, and adopted Resolution No. 15-22
titled, “Amending the Master Fee Schedule by establishing one new application
fee, based on time and materials, for Zoning Clearances for Housing Projects
Eligible for Streamlined Approval.”

7) UNFINISHED BUSINESS
7.1 SCS Property Community Outreach
Councilmember Hu recused herself from this item due to her residence being
within 500 feet of the SCS property, and therefore considered to be involved in
the decision, and left the dais.

The City Council received a presentation and considered approving the Preferred
Plan for the SCS Property.
Tom Evans provided public comment.
Ed Fisher provided public comment.
Richard Li provided public comment.

Inge Houston provided public comment.
On motion by Councilmember Kumagai, seconded by Vice Mayor Josey, and by a
3-1 roll call vote, with Mayor Hernandez voting no and Councilmember Hu
recusing herself, the City Council adopted Resolution No. 16-22 titled, “Approving
the Preferred Plan for the SCS Property.”

Mayor Hernandez called for a recess at 10:41 p.m.
Mayor Hernandez resumed the meeting at 10:54 p.m.
Councilmember Hu returned to the dais.
7.2 Authorize a Budget Shift to Fiscal Year 2021-22 for the Iron Horse Nature
Park and Open Space Project Property Community Outreach
The City Council received a presentation and considered shifting funds to Fiscal
Year 2021-22 for the Iron Horse Nature Park and Open Space project (CIP No.
PK0422) to allow for design work to begin in the current fiscal year on the first
phase of the project to meet a State grant deadline for a completed project by
December 31, 2023.
On motion by Councilmember Kumagai, seconded by Vice Mayor Josey, and by
unanimous vote, the City Council authorized a budget change for the shifting of

funds to Fiscal Year 2021-22 for the Iron Horse Nature Park and Open Space
Project.

8) NEW BUSINESS
8.1 Transition to District-Based Councilmember Elections
The City Council received a presentation and considered adopting a resolution of
intent to transition from at-large elections to a district-based councilmember
election system after receiving a notification threatening litigation under the
California Voting Rights Act if the City did not convert from at-large elections for
electing members of the City Council to district-based elections.
On motion by Councilmember McCorriston, seconded by Councilmember
Kumagai, and by unanimous vote, the City Council adopted Resolution No. 17-22
titled, “Declaring Its Intention to Transition From an At-Large Election System to
a District-Based Election System.”

8.1 Discussion Regarding City Council Salaries
By consensus, the City Council agreed to bring Item 8.2 back to a future City
Council meeting in March 2022 due to the late hour.
9) OTHER BUSINESS
The City Council and Staff provided brief information-only reports, including
committee reports and reports by City Council related to meetings attended at
City expense (AB1234).
By consensus, the City Council directed Staff to bring back an item regarding
the installation of community mini-libraries to a future meeting agenda,
sometime in late March or April 2022, and directed Staff to bring back a

proclamation for Arts Education in the month of March and a proclamation for
Arts, Culture, and Creativity for the month of April to the March 15, 2022 City
Council meeting.
10) ADJOURNMENT
Mayor Hernandez requested a moment of silence in memory of fallen Dublin
Police Deputy Aubrey Phillips and adjourned the meeting at 11:30 p.m. in her
honor.
