Additional Meeting Procedures Available During the COVID-19 Pandemic This City Council meeting will be broadcast live on Comcast T.V. channel 28 beginning at 7:00 p.m. This meeting will also be livestreamed at www.tv30.org and on the City’s website at: https://dublin.ca.gov/ccmeetings Members of the public who wish to participate in the meeting electronically have the option of giving public comment via Zoom, subject to the following procedures:  Fill out an online speaker slip available at www.dublin.ca.gov. The speaker slip will be made available at 10:00 a.m. on Tuesday, June 21, 2022. Upon submission, you will receive Zoom link information from the City Clerk. Speakers slips will be accepted until the staff presentation on an agenda item ends, or until the public comment period on non-agenda items is closed.  Once connected to the Zoom platform using the Zoom link information from the City Clerk, the public speaker will be added to the Zoom webinar as an attendee and muted. The speaker will be able to observe the meeting from the Zoom platform.  When the agenda item upon which the individual would like to comment is addressed, the City Clerk will announce the speaker in the meeting when it is their time to give public comment. The project is being coordinated in collaboration with neighboring Tri-Valley cities. It will feature decorated, oversized picture frames in prominent and picturesque locations throughout the Tri-Valley, including eight in Dublin. STAFF RECOMMENDATION: Approve the proposals for the “Picture This” temporary public art project. The project will perform pavement repairs, asphalt concrete overlay, and other roadway improvements on Dublin Boulevard between Scarlett Drive and Hacienda Drive. The City Councilmembers will determine whether the statement of qualifications each candidate is allowed to place in the sample ballot should be a maximum of 200 or 400 words and whether the City or each candidate should pay the costs associated with printing their candidate statement. STAFF RECOMMENDATION: Take the following actions: 1) adopt the Resolution Calling for a General Municipal Election To Be Held in the City of Dublin on November 8, 2022, Requesting the Alameda June 21, 2022 Dublin City Council Regular Meeting Agenda 5 County Board of Supervisors Consolidate the City of Dublin General Municipal Election With the Statewide General Election, Authorize Certain Procedural Matters, and Adopting Regulations for Candidates for Elective Office Pertaining to Candidate’s Statement and the Costs Thereof; and 2) affirm Resolution No. 85-10 Encouraging Candidates to Use the Code of Fair Campaign Practices. In addition, The California Department of Tax and Fee Administration (CDTFA), requires that the City reestablish the authorization of designated representatives, with HdL, every time a new agreement if put into place, to comply with the current requirements of Section 7056 of the California Revenue and Taxation Code which sets forth the requirements and conditions for the disclosure of CDTFA records. STAFF RECOMMENDATION: Adopt the Resolution Approving a Consulting Services Agreement between the City of Dublin and Hinderliter, de Llamas and Associates, and adopt the Resolution Authorizing Examination of Sales and Use Tax Records. Staff Report 4.13 Annual Update to the Master Fee Schedule The City Council will consider adopting an annual update to the Master Fee Schedule as prescribed by the City’s User Fee Cost Recovery Policy (Resolution 160-12). Staff Report Attachment 1 - Resolution Adopting an Annual Update to the Master Fee Schedule for Service Provided by the City Attachment 2 - Exhibit A to the Resolution - City of Dublin Master Fee Schedule, FY 2022- 23 Attachment 3 - City of Dublin Master Fee Schedule Prior to Rounding 4.14 Authorizing Remote Meetings of City Council and City Commissions Due to Increase in COVID-19 Cases From March 2020 through September 2021, the City conducted meetings of its legislative bodies remotely pursuant to various executive orders that suspended certain Brown Act provisions. In October, the City returned to in- person meetings and at the same time June 21, 2022 Dublin City Council Regular Meeting Agenda 7 state law changed to require certain findings to be made for an agency to meet remotely. Under the new law, AB 361, the City can conduct virtual meetings where the Governor has proclaimed a State of Emergency and state or local health officials have imposed or recommended social distancing or where the City Council has declared the need to meet remotely due to imminent risks to the health or safety of attendees. On January 11, 2022, the City Council adopted a resolution pursuant to AB 361 authorizing remote teleconferenced meetings for a 30 day period ending February 10, 2022. Due to the current increase in cases resulting from the Omicron variants, it would be prudent for the City Council and City Commissions to have the ability to attend meetings virtually for at least the next 30 days. The City Council will consider adopting a resolution that would allow for virtual attendance for the next 30 days. STAFF RECOMMENDATION: Adopt the Resolution Finding That There is a Proclaimed State of Emergency; Finding That Meeting in Person Would Present Imminent Risks to the Health or Safety of Attendees as a Result of the State of Emergency; and Authorizing Remote Teleconferenced Meetings of the Legislative Bodies of the City of Dublin Pursuant to AB 361. Staff Report Attachment 1 - Resolution Finding That There is a Proclaimed State of Emergency; Finding That Meeting in Person Would Present Imminent Risks to the Health or Safety of Attendees as a Result of the State of Emergency; and Authorizing Remote Teleconferenced Meetings of the Legislative Bodies of the City of Dublin Pursuant to AB 361 4.15 Dublin Senior Living Project (PLPA-2021-00042) On June 7, 2022, the City Council held a Public Hearing to consider the Dublin Senior Living Project consisting of a two-story, 155,517- square -foot building with 152 units, including 114 assisted living units, 38 memory care units and a total of 174 beds. The City Council waived the first reading and introduced the Ordinance approving the Planned Development Zoning and adopted a Resolution approving the Site Development Review Permit. The City Council will hold a second reading of the Ordinance approving the Planned Development Zoning. STAFF RECOMMENDATION: Waive the reading and adopt the Ordinance Considering the CEQA Addendum, Amending the Zoning Map and Approving a Planned Development Zoning District with a Related Stage 1 and Stage 2 Development Plan for the Dublin Senior Living Project. The proposed rates include the costs associated with implementing California State Senate Bill (SB) 1383, which created regulations to increase the diversion of organic waste from landfills. At the February 15, 2022, meeting, the City Council adopted a Resolution Declaring its Intention to Transition From an At-Large Election System to a District-Based Election System. The City has held two Public Hearings, in accordance with Elections Code section 10010, for the community to provide input on the composition of the districts prior to any maps being drawn. The City must now hold two additional public hearings over a period of no more than 45 days for the public to provide input regarding draft maps, sequence of elections, communities of interest, and potential district boundaries, and to provide direction on draft maps options and refinements. Maps considered at this meeting must have been published at least seven days before the public hearing. Representatives from June 21, 2022 Dublin City Council Regular Meeting Agenda 10 National Demographics Corporation will provide a brief presentation prior to the public hearing to review the draft maps and legal criteria for district maps. STAFF RECOMMENDATION: Receive the presentation, open the public hearing, receive public comment, provide direction to staff regarding preferred configurations and changes to draft maps, close the public hearing.
