The General Plan Land Use Element Map and the Eastern Dublin Specific Plan depict roadway alignments and land use designations for existing and proposed development within the Specific Plan boundary. The designations within the Specific Plan are not exact; rather the roadway alignments and land use designations are approximate. The Specific Plan allows for flexibility in the location of roadway alignments as necessary when individual applications for development are submitted. The City of Dublin Municipal Code allows for the establishment of future right-of--way lines for purposes of future widening, COPIES TO: PA File Mailing list ITEM NO. extension, or creation of streets, highways, or space for future utilities, pedestrian ways, fire and police emergency access, access to property and all public rights-of--way. In accordance with State Planning and Zoning Law, a local planning agency must report on the conformity to the General Plan as to the location, purpose and intent of the future right-of--way line prior to the establishment of said right-of--way lines. The proposed project includes the following actions: 1 Consider the adoption of the Negative Declaration in accordance with CEQA guidelines; 2 Consider the report on General Plan Conformity in relation to the proposed right-of--way lines; and 3 Consider the establishment of Dublin Boulevard and Fallon Road Right-Of--Way Lines and recommend the appropriate action to the City Council. BACKGROUND: Dublin Ranch Areas B E PD Zoning: In 1997 the City Council approved (Resolution 141-97) a Planned Development (PD) District Rezone for Dublin Ranch Areas B-E. The exhibits for this Stage 1 PD (see Attachment 2) are based on an alignment for Fallon Road that is east of the home on the Jordan Property, and on an alignment for Dublin Boulevard that intersects Fallon Road approximately 700 feet north of the I-580 off ramp. The portion of the PD for Dublin Ranch Areas B-E that is affected by the proposed Precise Alignment is Area B south of Central Parkway and east of Lockhart Street, and Area C. The land uses for this 149-acre area are summarized in the Land Use Summary Table on page 4. Fallon Road Alignment: In March of 2004 the City Council approved (Resolution 47-04) a General Plan Amendment and Planned Development District Rezone for Dublin Ranch Area F and the portion of Area B north of Central Parkway. To avoid red-legged frog habitat and to establish the boundary for the Fallon Sports Park, the 2004 General Plan Amendment and PD modified the Fallon Road alignment to be along the existing roadway. The modified Fallon Road realignment also results in minor adjustments in the land use areas in Dublin Ranch Area B, south of Central Parkway. ANALYSIS: Precise Alignments for Future Right of Way Lines The establishments of Right-Of--Way Lines are intended to reserve sufficient right-of--way for future road construction. Adoption of the Right-Of--Way Lines will not result in the immediate acquisition of any property, but will preclude property owners from constructing structures within the future right-of--way area. The legal descriptions and plats (Exhibit A of Attachment 5) for the proposed Right-Of--Way Lines show the right-of--way that will be required from four properties. Two of the properties are part of the Lin Family's Dublin Ranch (APN's 985-054-004, 006, 007 and 985-027-009). The other two properties are owned by the Lowell A. Jordan Trust Fund (APN 985-0027-007) and Royal-Formosa, Inc (APN 985- 0027-002). The right-of--way on these latter properties is not needed until Fallon Road is widened to its ultimate six and eight lanes. Fallon Road between Bent Free and I-S80: Fallon Road between Bent Tree Drive and I-580 is currently a two-lane road within a 60-foot wide easement. To accommodate projected traffic needs Fallon Road is planned to be six lanes between Bent Tree Drive and Dublin Boulevard within a 140-foot right of way, and eight lanes between Dublin Boulevard and I-580 within a 175-foot right of way. The right of way will be wider than the 140 & 175-foot widths at intersections to accommodate turning lanes. Currently Dublin Page 2 Boulevard does not exist between Lockhart Street and Fallon Road. Dublin Boulevard is planned to be a four-lane road within a 150-foot right of way. 'The proposed alignments for these roadways are shown on Attachment 1. Dublin Boulevard /Fallon Road Intersection: The 2002 Supplemental Environmental Impact Report for the EDPO (Eastern Dublin Property Owners) annexation and Stage 1 Planned Development states that the Dublin Boulevard /Fallon Road intersection would operate at Level of Service F. The EIR further states that the EDPO developers shall pay for studies to assess the feasibility of locating the Dublin Blvd. / Fallon Road intersection farther north to allow for a signalized intersection between the I-580 and Dublin Boulevard, and that the EDPO developers shall implement this mitigation measure when traffic impacts from individual projects are determined to trigger the need for this improvement. Thus, if the Dublin Blvd. /Fallon Road intersection is not moved north, the only practical way for the EDPO developers to meet this mitigation measure would be to severely reduce the commercial and retail land uses on approximately 50 acres between Dublin Boulevard and I-580 east of Fallon Road. Dublin Boulevard Alignment: To mitigate the above traffic impact at the Dublin Boulevard /Fallon Road intersection, the proposed alignment of Dublin Boulevard is proposed approximately 400 feet north to accommodate an intersection between Dublin Boulevard and I-580. This proposed roadway alignment and resulting land use shifts are shown on Attachment 3. Land Use Surrounding Proiect Area Open Space: The Eastern Dublin Specific Plan adopted in 1994 designates a series of low-lying knolls that run parallel to I-580 as Open Space. The objective of preserving these knolls as open space area is to provide a natural visual backdrop to proposed development along the freeway and to serve as a buffer screening development to the north from freeway views and noise. Three of the knolls are west of Fallon Road and five are east within the EDPO development. The 1997 proposed alignment of Fallon Road through the Jordon property would have significantly altered the land form of the knoll on the east side of Fallon Road, whereas, the realignment of Fallon Road along the existing road alignment will alter the lower existing knoll just west of Fallon Road. The proposed plan is to use the cut material from the Fallon Road grading to reconstruct the middle and eastern knolls into one knoll approximately 150 feet south of the existing middle knoll. The new knoll would be shaped to match the contours of the existing knolls and hydro seeded with native grasses and wildflowers. The 1997 Planned Development allowed steep artificial slopes and walls on the back side of the knolls for the development in the Median High Residential area. With the proposed reshaping of the middle knoll, more natural slopes on the north side of the knoll can be achieved with development in the Medium High Residential area. With the proposed plan the Dublin Boulevard /Fallon Road intersection would have open space fronting Fallon Road on both sides north of Dublin Boulevard, and on the north side of Dublin Boulevard both east and west of Fallon Road thus better fulfilling the objectives in the Eastern Dublin Specific Plan. While there is a slight increase in gross acreage of open space, the net acreage will slightly decrease due to the increase in Fallon Road and Dublin Boulevard rontage. Medium High Density Residential: The 1997 PD Zoning contained 8.6 gross acres of median high- density residential land use on the north slope of the knolls. With the proposed roadway alignments, the median high-density residential land use area would increase to 10.6 gross acres; however, most of the increase is due to the additional Fallon Road frontage. Medium Density Residential: The proposed plan contains 23.2 gross acres for medium density residential land use. This is a reduction of 4.0 acres from the 27.2 gross acres in the 1997 PD Zoning. Stream Corridor: To meet the Army Corps of Engineers Permit requirements with the current configuration of the sports park, the stream corridor will need to extend approximately 1,000 feet south of Page 3 Central Parkway resulting in 2.4 gross acres, which is an increase of 1.1 acres from the area contained in the 1997 PD Zoning. Neighborhood Square: The neighborhood square remains at 2.0 acres. General Commercial: With the realignment of Dublin Boulevard approximately 9.2 acres of the general commercial area would be moved from the north side of Dublin Boulevard to the south side. Approximately 3.3 gross acres would remain on the north side of Dublin Boulevard. The total area of General Commercial would remain at 41.2 gross acres. Commercial Office: The total area of Commercial Office would remain at 44.6 gross acres. In addition, Government Code §65402 states, in part, that if a General Plan has been adopted, no real property shall be acquired by dedication or otherwise for street purposes until the location, purpose, and extent of such acquisition have been submitted to and reported upon by the Planning Agency (Planning Commission) as to conformity with the adopted General Plan. Upon receiving a report and recommendation from the Planning Commission, the City Council can then adopt a Resolution of Intention designating the establishment of aRight-Of--Way Line. A public hearing can then be conducted so the City Council can hear testimony related to the proposed Right-Of--Way Lines. Finally, the City Council can adopt an Ordinance establishing the Right-Of--Way Lines described in the Resolution, if appropriate, and have the Ordinance recorded with the County Recorder. The land use designations and roadways depicted on the General Plan and Specific Plan are not exact; rather the roadway alignments and land use designations are approximate. Flexibility on the precise location of land uses and road alignments is permitted as necessary to accommodate individual applications for development provided that the integrity of the plan remains intact. The proposed Right- Of-Way Lines would create precise alignments for roadways currently depicted on the General Plan. In doing so, the Right-Of--Way Lines would shift the Dublin Boulevard/Fallon Road intersection north, shift the Fallon Road alignment west and modify the locations of land uses depicted on the General Plan. As Page 4 indicated within that table above, the most significant area of change involves shifting the majority of the commercial designation south of Dublin Boulevard and increasing the Open Space designation on the north side of Dublin Boulevard. The proposed alignment will set in place precise alignments for roadways currently depicted on the General Plan and, in doing so, said Right-Of--Way Lines do not substantially change the acreages described for each designation nor does it change the permitted density; therefore, the proposed right-of--way alignments conform to the current General Plan. ENVIRONMENTAL REVIEW: A Negative Declaration (Exhibit A of Attachment 4) was prepared pursuant to the California Environmental Quality Act (CEQA). The changes proposed by this Right-of--Way alignment are a northerly shift of the intersection for Dublin Boulevard and Fallon Road and a westerly shift of Fallon Road between Bent Tree and I-580. The proposed alignment does not change the analysis, conclusions, or mitigation measures of the 1993 Eastern Dublin Specific Plan EIR and will not have a significant impact on the environment. RECOMMENDATION: Staff recommends that the Planning Commission (1) Hear Staff presentation, (2) Open Public Hearing, (3) Close public hearing and deliberate, (5) Adopt resolution for a Negative Declaration and a Report of Conformance with the General Plan for the Precise Alignments for the future Right-Of--Way Lines for Dublin Boulevard (between Keegan Street and Fallon Road) and Fallon Road (between Bent Tree Drive and I-580) and (6) Adopt resolution recommending the City Council adopt a Resolution of Intent to establish precise alignments for the future Right-Of--Way Lines for Dublin Boulevard (between Keegan Street and Fallon Road) and Fallon Road (between Bent Tree Drive and I-580). Exhibit 1 depicts the location of the proposed right- of-way alignments in context of the larger Eastern Dublin Area. Exhibit 2 depicts the project site under existing conditions. Surrounding land uses consist of the following: to the east is undeveloped property within the Eastern Dublin Property Owner's planning area; to the north is the future Fallon Sports Park and single-family residences; to the west is Planning Area G which is a neighborhood of approximately 1,400 multi-family units including town homes, condominiums and apartments; and to the south undeveloped property with a Stage 1 land use designation of General Commercial. Project Proposal: The proposed project consists of a report on General Plan Consistency, as required per State Planning Law Section 65402, and establishment of Right-of-Ways lines for Fallon Road (between Bent Tree and 1- 580) and Dublin Boulevard (between Keegan Street and Fallon Road). The purpose of establishing Right- of-Way lines is to reserve sufficient right-of-way for future road improvements. The Specific Plan depicts approximate roadway alignments and land use designations within the Specific Plan boundaries. The Specific Plan allows for flexibility of the location for roadways and land uses as individual development applications are submitted. Though the Specific Plan did not depict exact roadway alignments, the plan does establish a framework for development based on a mixture of land use densities and intensities. The proposed Right- of-Way lines will trigger minimal modifications to the land uses depicted on the current General Plan land use map and changes to two separate Stage 1 land use approvals: Area B and Area C (PA96-037). Aesthetics Project Impacts and Mitigation Measures a-d) Affect a scenic vista or view or damage scenic resources? PS/M. Based on a field observation of the project site and review of Eastern Dublin Specific Plan policies, the damages to a scenic resource proposed within this project were analyzed in the 1993 Eastern Dublin EIR. The proposed right-of-way lines would affect one of the foreground hills, which are identified in the Eastern Dublin EIR as a scenic resource. The Eastern Dublin Specific Plan EIR required the creation of a Scenic Corridor Policy document to set parameters for development amongst areas designated as scenic resources. The proposed right-of-way alignment would require the relocation of an existing foreground hill. The proposal includes shifting the existing hill south to allow the preferred road alignment. The project is in compliance with the Scenic Corridor Policies because the request includes the relocation of a foreground hill be maintained within project area to be viewed by both pedestrian and vehicular traffic. This potential for visual impacts to scenic resources was adequately addressed in the 1993 EIR; no mitigation measures are required. II. Agricultural Resources Project Impacts and Mitigation Measures a-c) Convert Prime Farmland, conflict with agricultural zoning or convert prime farmland to a non- agricultural use? NI. The 1993 EIR analyzed the conversion of farmland as a result of development. The purpose of establishing right-of-way lines is to reserve sufficient right-of-way for future roadway construction. The proposal to establish right-of-way lines requires minor modifications to the existing General Plan Land Use Map. Said changes are depicted within this Initial Study on page 4.
