4 RESOLUTION NO. 110 -86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN RESOLUTION APPROVING "CITY OF DUBLIN ANNEXATION #2 - PUBLIC LANDS (CAMP PARKS) " WHEREAS, the Dublin City Council has initiated the annexation of certain inhabited territory designated as "City of Dublin Annexation #2 - Public Lands (Camp Parks) "; and WHEREAS, LAFCO has, at the times, in the form, and in the manner provided by law, considered the petition of the City; and WHEREAS, LAFCO has authorized the City to proceed with the annexation by LAFCO, and has approved the annexation subject to the following terms and conditions: a) Correction of the map and description as may be required by the Director of Public Works, ex- officio County Surveyor; and b) Designate the City of Dublin as the conducting authority and authorize the City to initiate proceedings for the proposed annexation in compliance with this resolution; and c) The Alameda County Local Agency Formation Commission recommends that the City of Dublin study the Property to determine if there are areas within the Property which may be benefited by the Freeway Improvements and if such benefits are found, to support the creation of an assessment district or similar vehicle for the financing of the cost of construction of that portion of the Freeway Improvements which confer special benefits on areas within the Property; and d) The Alameda County Local Agency Formation Commission further recommends that the City of Dublin participate jointly with the City of Pleasanton and any other public agencies having jurisdiction within the Property in formation of a joint powers or other special purpose entity or commission, for the purpose of defining a "scope of work" for the Freeway Improvements, determining the cost thereof, and retaining an "engineer of work" to determine the boundaries of the Benefited area. The object of the City of Dublin's participation with other public agencies shall be to attain an official determination of the extent of improvements, cost of improvements, and proportion of costs to be borne by the Benefited Area. WHEREAS, notice of the public hearing was duly given in accordance with law; and WHEREAS, the Council held a public hearing at 7:30 p.m., October 13, 1986, at the City Council's regular meeting place, to consider testimony concerning the proposed annexation; and WHEREAS, all oral and written protests, objections and evidence were considered by the City Council; WHEREAS, after closing the public hearing, the Council determined that written protests have been filed and not withdrawn by less than 25% of the registered voters or less than 25% of the number of owners of land owning less than 25% of the assessed value of land within the affected territory. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City Council does hereby find that: Section 1. That pursuant to the provisions of the Cortese -Knox Local Government Reorganization Act of 1985, Government Code §§ 56000 et seq., the Council approves and orders, without election, the annexation of that real property situate in the County of Alameda, State of California (designated as "City of Dublin Annexation #2 - Public Lands (Camp Parks)" and more particularly described in Exhibit "A" attached hereto and incorporated herein by reference, to the City of. Dublin. Section 2. The reason for said .annexation is to facilitate orderly growth and development of the subject property in a manner consistent with the Legislature's findings and declarations, as contained in Government Code § 56001. Section 3. The regular county assessment roll will be utilized. Section 4. The real property to be annexed will not be taxed for existing general bonded indebtedness by the City of Dublin. Section 5. That the City Clerk is directed to send a certified copy of this resolution to the LAFCO Executive Officer. PASSED, APPROVED AND ADOPTED this 13 th day of October 1986. AYES: Councilmembers Hegarty, Jeffery, Moffatt, Vonheeder and Mayor Snyder NOES: None ABSENT: None ayor ATTEST: S City Clerk a EXHIBIT "A" DESCRIPTION OF PROPOSED ANNEX TO THE CITY OF DUBLIN November 1, 1985 All that certain real property situated in the counties of Contra Costa and Alameda, State of California, described as follows: A PORTION of the 3636.1222 acre tract of land commonly known as Camp Parks Military Reservation, acquired by the United States of America, by Decree of Final Condemnation, made by the District Court of the United States for the Northern District of California, Southern Division, Case Number 22352 -R, a certified copy of which was recorded August 1, 1947, in Book 5132 of Official Records, page 1 (AB 65698) Records of Alameda County, California, described as follows: BEGINNING at a point on the boundary line dividing Alameda County from Contra Costa County, said boundary line was established by that certain "REPORT ON A JOINT RETRACEMENT SURVEY AND MONUMENTATION OF A PORTION OF THE BOUNDARY LINE BETWEEN.ALAMEDA AND CONTRA COSTA COUNTIES - 1960" approved by the Board of Supervisors of Alameda County under Resolution No. 99517, adopted February 27, 1962 and filed in Reel 1 of Minutes, Image 966, said point being the intersection with the centerline of County Road No. 4038, commonly known as Dougherty Road, 50 feet in width, as said centerline is described in that certain AMENDED JUDGMENT, Case No. 22352 -R; IN THE DISTRICT COURT OF THE UNITED STATES IN AND FQR THE NORTHERN DISTRICT OF THE CALIFORNIA SOUTHERN DIVISION, UNITED STATES OF AMERICA, Plaintiff v. 3396 Acres of land, Alameda and Contra Costa Counties, California, et al, Defendants, done in open court on June 4, 1945, a certified copy of which was recorded June 8, 1945, in Book 4721 of Official Records, page 14, Records of Alameda County, California, said centerline being in common with the general westerly boundary of said Camp Parks Military Reservation and coterminous with the general easterly boundary line of that certain territory, known as Volk- McLain Company Annexation, annexed to Parks Community Services District now known as Dublin San Ramon Services District, said boundary being established under Ordinance No. 1 of Parks Community Exhibit A 11/05/85 Page 2 Services District now known as Dublin San Ramon Services District, said boundary being established under Ordinance No. 1 of Parks Community Services District, a certified copy of which was recorded July 11, 1960, in Reel 123 of Official Records, Image 272 (AR 79980), Records of Alameda County, California; thence from said point in a general easterly direction along said boundary line dividing Alameda County from Contra Costa County; to the intersection thereof with the general northwesterly line of that certain parcel of land conveyed to East Bay Regional Park District by Quitclaim Deed recorded April 5, 1973 in Reel 3382 of Official Records, at Image 477 (73- 44684) Records of Alameda County, California; thence in a general southerly direction, along the easterly line (73- 44684) to the intersection thereof with the northeastern corner of that certain Record.of Survey No. 385, filed October 28, •1970 in Book 8 of Records of Surveys at pages 27 through 29 inclusive (70- 118.534) Records of Alameda County, California; thence in a general southerly direction along the easterly line (70- 118534) to an angle point on the general northerly boundary line of that certain territory annexed to the City of Pleasanton by Pleasanton City Council Ordinance No. 646, adopted November 8, 1971, a map of which was filed December 10, 1971 in Map Book 73 at Page 7 (71- 162868) Records of Alameda County, California; thence southerly and westerly along said general northerly boundary line (71- 162868) to the intersection thereof with the northerly boundary line of that certain territory annexed to the City of Pleasanton by Pleasanton City Council Ordinance No. 803, adopted February 14, 1977, a map of which was f i led August 9, 1977 in Map Book 90 at Page 18 (77- 158324) Records of Alameda County, California;
