OF THE CITY OF DUBLIN

APPROVING PARCEL MAP 8310 (VALLEY CHRISTIAN SCHOOL),
ACCEPTING OFFER OF DEDICATION FOR STREET PURPOSES
AND ACCEPTING GRANT 01<' CONSERVATION EASEMENT
WHEREAS, Parcel Map 8310, in the incorporated territory of thc City of Dublin, State of
California, has been presented to this City Council for approval, all in accordance with provisions ofthc
Subdivision Map Act of the Statc of California and the City of Dublin Municipal Code; and
WHEREAS, the City of Dublin Planning Commission adopted Resolution No. 03-17 on April 22,
2003, approving the Vesting Tentative Map and Site Development Review for Parcel Map 8310, subject
to Conditions of Approval regarding required on-site/oiT-site improvcmcnts (P A 00-017); and
WHEREAS, Parcel Map 8310 ineludes an offer of dedication for public street purposes to the
public; and
WHEREAS, Condition No. 39 of the Conditions of Approval requires the dedication of a
conservation cascmcnt ovcr a portion of Parcel 3 as shown on the Tentative Map; and
WHEREAS, a grant of conservation easement has been received from Vallcy Christian Schoo! in
compliance with Condition No. 39.
NOW, THEREFORE, BE IT RESOLVED that Parcel Map 8310 is hereby approved, and that
rights to thc areas marked as offcrcd for dcdication to public use for public street purposes in conformity
with the temlS of dedication are hereby accepted, and that the Clerk of this City Council is hereby directed
to transmit said Map to the County Recorder for filing.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized by the City Council to
accept the grant deed, attached hereto as Exhibit "A."

GRANT OF CONSERVATION EASEMENT
This Grant of Conservation Eascmcnt is made by Valley Christian Center of
Dublin ("VCC") in favor of the City of Dublin, California, a municipal corporation
("City").
RECYr ALS
A. VCC owns that certain real property in the City of Dublin commonly
known as 7500 Inspiration Drive, Dublin, California ("thc Property").
B. VCC recently sought City approval for a master plan for the future
dcvclopmcnt of the Property and an associated parcel map ("the Approvals") and
expressed a dcsire that ccrtain portions of the property remain permanently undcvcloped.
The Approvals were finally granted by City Council Resolution Nos. 092-03 and 093-03
adopted on May 20, 2003. In conjunction wilh the Approvals, VCC agreed to a condition
that rcquircs the recordation of a conservation easement or deed restrictions that preclude
dcvelopment on those portions of the Propetty.
C. Accordingly, VCC and City dcsire to limit the use of a portion of thc
propelty more particularly descrihed in Exhibit A attached hereto, by grant of a
conservation easement in order to reduce potential adverse impacts on such land
including grading, vegetation removal, and erosion, recognizing that such land is
essentially unimprovcd and if retained in its natural state has substantial sccnic value to
the public and that the preservation of such land as open space constitutes an important
physical, social, aesthetic and economic asset to the City and to VCC.
D. City has indicated that the conservation easement that would be created by
the acceptance of this grant is consistent with the City's Genera] Plan, satisfies the
conditions of thc Approvals, and is in the best interests of the City_
NOW, THEREFORE, VCC, as grantor, hereby grants, conveys, and transfers a
conservation easement to thc City of Dublin, a municipal corporation, County of

Alameda, State of Ca1ifornia, ovcr the real property described and shown as Exhibit A,
("the Site"), to have and to hold said conscrvation easement for the term and for the
purposes and subject to the conditions, covenants, and exceptions described hcrcin.
I. Statutory Authorization. This grant of conservation easement is made and
entered into pursuant to Chapter 4 commcncing with Section 815 of Part 2, Division 2,
Title 2 of the Civil Code. It is suhject to all of the provisions of said scctions and
chapters including any amendments thereto which may hereafter be enacted.
2. Rcstriction on Use of Site. During the tcrm of this conservation easemcnt
granted herein, thc Site shall not be used for any purpose other than a conservation
easement and thosc uscs rclated to or compatible therewith. VCC, for the direct benefit
of the Site described herein, hercby declares that the Site shall be subject to restricti ve
covcnants running with the land which shall be binding upon all subsequent grantees.
Said restrictivc covenants shall be:
a. against the right of VCC to construct any improvements on or
within the Site except for public and private utilities, provide these reserved exceptions
shall be consistent with the purposcs of maintaining and preserving thc natural or scenic
charactcr of the land; and
b. against the extraction of natural resources or othcr activities which
may dcstroy the unique physical and scenic characteristics of the land; and
c. against the grading of land for reasons other than attendant to
pcrmittcd uses; and
d. against the erection of structurcs other than lawful fences.
Notwithstanding the foregoing, VCC may landscape the Site and may perform such
ordinary and customary activities as are necessary to maintain such landscaping. VCC
may also perfoml weed abatcment activities in conformance with the City's Wildfire
Management Plan.
3. ExcePtions. Thc Dublin City Council may authorizc exceptions to the
foregoing restrictive covcnants, provided such exceptions are consistent with the
purposes of law and not incompatible with maintaining and prescrving the natural
character of the land.
4. Restrictions on Public Use. The public shall not have a right of entry upon
thc Sitc. The right of entry and surface use is limited solely to the City, but on1y for thc
purpose of inspection of condition of the Property.
5. Teml of Easemcnt. Upon acceptance, this conservation easement shall
remain in effect in perpetuity, unless abandoned pursuant to Government Code Sections
51093 and 51094, or any successor legis1ation.

7. Successors in Intere~t. Thi~ conscrvation easement shall run with the
Property and shall be binding upon and inure to the benefit of the heirs, successors and
assigns of the parties hereto.

between Valley Christian Center, and the City of Dublin, a Municipal Corporation and

City Council of the City of Dublin, pursuant to authority conferred by Resolution No. 24-
87 of the Dublin City Council adopted on April 13, 1987, and the Grantee consents to

RELATED TO THE DESIGNATION OF OFFICERS AUTHORIZED
TO ACCEPT AND DIRECT RECORDATION OF DEEDS
WHEREAS, the City Council is desirous of developing an
efficient mechanism for the acceptance of deeds; and
WHEREAS, Section 27281 of the California Government Code
(CGC) requires that deeds or grants conveying any interest in or
easement upon real estate to a governmental agency for public
purposes must meet specific requirements; and
WHEREAS, the requirements include evidence of a
certificate or resolution of acceptance attached to the deed or
grant prior to recordation; and
WHEREAS, Section 27281 provides that a governmental
agency may authorize one or more officers by general resolution to
accept and consent to such deeds or grants.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Dublin, pursuant to section 27281 (CGC), does hereby
authorize the City Manager and/or the City Engineer to accept and
consent to such deeds or grants, conveying any interest in or
easement upon real estate, on behalf of the City of Dublin.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

RELATED TO THE DESIGNATION OF OFFICERS AUTHORIZED
TO ACCEPT AND DIRECT RECORDATION OF DEEDS
WHEREAS, the City Council is desirous of developing an
efficient mechanism for the acceptance of deeds¡ and
WHEREAS, Section 27281 of the California Government Code
(CGC) requires that deeds or grants conveying any interest in or
easement upon real estate to a governmental agency for public
purposes must meet specific requirements¡ and
WHEREAS, the requirements include evidence of a
certificate or resolution of acceptance attached to the deed or.
grant prior to recordation¡ and
WHEREAS, Section 27281 provides that a governmental
agency may authorize one or more officers by general resolution to
accept and consent to such deeds or grants.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Dublin, pursuant to Section 27281 (CGC) , does hereby
authorize the City Manager and/or the City Engineer to accept and
consent to such deeds or grants, conveying any interest in or
easement upon real estate, on behalf of the City of Dublin.
PASSED, APPROVED AND ADOPTED this 13th day of April,
1987.
