A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

ACCEPTANCE OF OFF-SITE IMPROVEMENTS TO TASSAJARA ROAD
FOR TRACT 7441, PHASE 1- SILVERA RANCH
(PFEIFFER RANCH INVESTORS n, tNe.)
WHEREAS, the subdivider of Tract 7441, filed on March 11, 2005, in Book 279 of Maps at
Pages 68 - 82, previously entered into an Improvement Agreement with the City of Dublin to construct
certain off-site improvements on Tassajara Road in accordance with plans and specifications on file with
the Public Works Director, said Tract identified as follows:

WHEREAS, the Silvera, Haight, and Nielsen properties, together with the abutting segment of
Tassajara Road (formerly County Road 2568), were annexed to the City of Dublin and to the Dublin San
Ramon Services District via Local Agency Formation Commission (LAFCO) Resolution No. 2003-01-A
on January 9, 2003 (recorded on May 5, 2003, in Book 264 of Maps at Page 34); and
WHEREAS, the off-site improvements within the annexed segment of Tassajara Road extending
trom the northern boundary of Dublin Ranch, Phase I, to the intersection with Silvera Ranch Drive of
Tract 7441, as governed by the Improvement Agreement, are complete in accordance with said plans and
specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director;
and
WHEREAS, the original Performance Bond and Labor and Materials Bond that guaranteed the
off-site improvements can be released, in accordance with the authority contained in §66499.7 of the
Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the
completed work for a one-year period following acceptance;
NOW, THEREFORE, BE IT RESOLVED that:
I. The storm drain improvements completed within Tassajara Road are hereby approved and
accepted subject to a one-year guarantee period; and
2. The original Performance Bond in the amount of $293,173 (Bond No. 868816S) issued by
Developers Surety and Indemnity Company be released; and
3. The original Labor and Materials Bond in the amount of $293,173 (Bond No. 868816S)
issued by Developers Surety and Indemnity Company be released; and
4. The submitted Maintenance Bond in the amount of $73,294 (Bond No. 868816S) issued by
Developers Surety and Indemnity Company for storm drain improvements be accepted as
security for the aforesaid one-year maintenance period, said period to commence on this
date and terminate on the 7th day of June, 2006.
PASSED, APPROVED AND ADOPTED this7th day ofJune, 2005.
