HomeMy WebLinkAboutPC Reso05-33 Rec CC Est ROW Dubl Fallon Rd RESOLUTION NO. 05 - 33 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN RECOMMENDING THE CITY COUNCIL ADOPT A RESOLUTION OF INTENTION TO ESTABLISH RIGHT-OF-WAY LINES FOR DUBLIN BOULEVARD BETWEEN KEEGAN STREET AND FALLON ROAD, AND FALLON ROAD BETWEEN BENT TREE DRIVE AND 1-580 WHEREAS, the City of Dublin has proposed the establishment right-of-way lines for Dublin Boulevard and Fallon Road in accordance with Municipal Code Chapter 7.68; and WHEREAS, the effected segment of Dublin Boulevard is between Keegan Street and Fallon Road; and WHEREAS, the effected segment of Fallon Road is between Bent Tree Drive and 1-580; and WHEREAS, the proposed Right-Of-Way Lines confonn to the lines previously established with the Final Map for Tract 7281 for the northern segment of Fallon Road; and WHEREAS, the properties through which the proposed Right-Of-Way Lines pass are within the boundary ofthe Eastern Dublin General Plan Amendment and Eastern Dublin Specific Plan and therefore will be encompassed by, and consistent with, the General Plan; and WHEREAS, an Agenda Statement was prepared on behalf ofthe City Engineer and submitted to the Planning Commission as required by Municipal Code Chapter 7.68 recommending that the Planning Commission recommend to the City Council adoption of a Resolution of Intention to establish Precise Alignments for the future right-of-way lines; and WHEREAS, the Planning Commission did hold a public hearing on May 24,2005; and WHEREAS, proper notice of said public hearing was given in all respects as required by law. WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth; and WHEREAS, the Right-Of-Way Lines are appropriate and compatible with the existing land uses and will not overburden public services; and WHEREAS, Precise Alignments for the future the right-of-way lines will not have a substantial adverse effect on health or safety or be substantially detrimental to the public welfare or be injurious to property or public improvements; NOW, THEREFORE, BE IT RESOLVED that the Dublin Planning Commission does hereby recommend that the City Council adopt a Resolution of Intention to establish Right-Of-Way Lines for Dublin Boulevard and Fallon Road as depicted on the legal descriptions and plats attached as Exhibit A. 1 PASSED, APPROVED, AND ADOPTED this 24th day of May, 2005.
