HomeMy WebLinkAboutReso 172-01 AVB Wid KindercareRESOLUTION NO. 172 - 01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ,.. ACCEPTING IMPROVEMENTS FOR THE WIDENING OF AMADOR VALLEY BOULEVARD AND FOR REQUIRED SITE IMPROVEMENTS (KINDERCARE LEARNING CENTERS, INC.) WHEREAS, the public right-of-way for Amador Valley Boulevard, in the incorporated territory of the City of Dublin, State of California, to serve the proposed Kindercare Learning Center, a Delaware Corporation, has been irrevocably dedicated to the public by separate instrument and recorded as Series No. 2001-012469, all in accordance with the Conditions of Approval for a Conditional Use Permit and Site Development Review (Planning Commission Resolution 00-27); and WHEREAS, the developer, Kindercare Learning Centers, Inc., previously entered into an agreement with the City of Dublin to improve said roadway and site in accordance with plans and specifications on file with the City Engineer, said improvements identified as folloWs: a) Developer: b) Location: c) Resolution Approving Agreement: d) City Street Affected: Kindercare Learning Centers, Inc. 11925 Amador Valley Boulevard 210-00 Amador Valley Boulevard WHEREAS, the improvements associated with Kindercare Learning Center are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the Performance Bond and Labor and Materials Bond can be released in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee maintenance of the completed work for a one-year period. NOW, THEREFORE, BE IT RESOLVED that: The improvements completed within Amador Valley Boulevard and required site improvements are hereby approved and accepted subject to a one-year guarantee period. The original Performance Bond issued by Travelers Casualty and Surety Company of America (Bond No. 103499097) in the amount of $336,650 be released. The original Labor and Materials Bond issued by Travelers Casualty and Surety Company of America (Bond No. 103499097) in the amount of $168,325 be released. The submitted Maintenance Bond issued by Travelers Casualty and Surety Company of America (Bond No. 103499097-M) in the amount of $84,163 be accepted as security for the aforesaid one-year maintenance period, said period to commence on this date and terminate on the 2nd day of October, 2002. PASSED, APPROVED AND ADOPTED this 2nd day of October, 2001.
