The Applicant, James Singleton of CalCom Systems, on behalf of Verizon Wireless has requested
approval of Site Development Review to construct an unmanned wireless telecommunications facility
within the existing steeple at S1. Raymond's Church, located at 11555 Shannon Avenue. The project
consists of six, 52-inch panel antennas to be mounted inside the existing steeple; a 16'xI6' (256 square
foot) equipment enclosure with two GPS antennas mounted to the inside wall of the enclosure; a 18'-
6"x 13' -8" (253 square foot) generator enclosure; and, the construction of a new trash enclosure for the
church facility (Attachment 2).
On September 29, 2004 an application for Site Development Review was received by the Planning
Division for the proposed wireless communication facility. Staff worked with the Applicant on the design
of the facility as well as the two equipment enclosure areas and new trash enclosure. A public notice was
sent out to all property owners and tenants within 300-feet of the project site for public comment on May
23, 2005. The public comment period was between May 24, 2005 and June 2, 2005.

During the public comment period the City received comments from two property owners, one via
telephone and the other via e-mail regarding the proposed project (Attachment 3). Both property owners
live within 300 feet of the project site and both have rear yards which abut the church's property. The
main concern expressed by the residents is the potential health risks of living in close proximity to a
wireless communication facility.
Also during the public comment period it was discovered that Section 8.92.030.C of the Wireless
Communications Facilities Regulations Ordinance prohibits wireless communication facilities on private
property within residential zoning districts. In consultation with the City Attorney's Office, it was
determined that the church property is "private property" notwithstanding the fact that it is considered a
public/semi-public use. Accordingly, the proposed facility is a prohibited use in the R-l Single Family
Residential Zoning District. Staff discussed the project with the Applicant in light of the new information
and recommended that the Applicant consider taking one ofthe following actions:
1. Withdraw the current application and submit a new application for a wireless communication
facility at Shannon Park. Shannon Park is located just north of St. Raymond's Church, on public
property. A wireless communication facility currently exists at Shannon Park and Verizon
Wireless could co-locate on this existing facility which is encouraged under the Wireless
Communication Facility Ordinance.
2. Withdraw the current application and apply for a rezoning of the St. Raymond's Church property
to change the zoning designation from R-l, Single Family Residential to Planned Development.
3. Withdraw the current application and request an amendment to the Dublin Zoning Ordinance to
modify Section 8.92.030.C to allow wireless communication facilities on private property in
residential zoning districts, with some restrictions.
After considering the options available to them, the Applicant decided to move forward with the current
application. Rather than deny the application and require the Applicant to appeal the decision, the
Community Development Director, under the authority granted in Section 8.96.020.C of the Zoning
Ordinance has referred decision making authority to the Planning Commission.
PUBLIC NOTIFICATION:
In accordance with State law, 10 days prior to a scheduled public hearing, a public notice is required to be
mailed to all property owners and tenants within 300 feet of a proposed project. Staff mailed a public
notice to all property owners and tenants within 500 feet of the proposed Verizon @ St. Raymond's
project. The public notice was also published in The Valley Times and posted at several locations
throughout the City.
RECOMMENDATION:
Staff recommends that the Planning Commission open the Public Hearing and receive Staffs presentation;
take testimony fiom the Applicant and the Public; question Staff, the Applicant, and the Public; close the
Public Hearing and deliberate; and, adopt a Resolution (Attachment 1) denying a Site Development Review
request to construct an unmanned wireless communication facility at 11555 Shannon Avenue (St.
Raymond's Church).

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
DENYING A SITE DEVELOPMENT REVIEW REQUEST FOR
AN UNMANNED WIRELESS COMMUNICATION FACILITY
LOCATED AT 11555 SHANNON AVENUE (ST. RAYMOND'S CHURCH)

WHEREAS, the Applicant, James Singleton of CalC om Systems, on behalf of Verizon Wireless,
has requested approval of Site Development Review to construct an unmanned wireless
telecommunications facility within the existing steeple at St. Raymond's Church, including six, 52-inch
panel antennas to be mounted inside the existing steeple; a 16' x 16' (256 square foot) equipment
enclosure with two GPS antennas mounted to the inside wall of the enclosure; a 18'-6" x 13'-8" (253
square foot) generator enclosure; and, the construction of a new trash enclosure for the church facility; and
WHEREAS, the Applicant submitted an application for Site Development Review on September
29,2004; and
WHEREAS, a Public Notice was sent out for public comment on the project; and
WHEREAS, the public comment period was between May 24, 2005 and June 2, 2005 during
which time public comments were received via telephone and in writing; and
WHEREAS, based on the public comments received it was determined that Section 8.92.030.C of
the Dublin Zoning Ordinance prohibits Wireless Communication Facilities on private property in
residential zoning districts; and
WHEREAS, the Community Development Director elected to not take action on the project at the
close of the public comment period; and
WHEREAS, the Zoning Ordinance does not require a public hearing for Site Development
Review however, the Zoning Ordinance allows an application to be referred to another decision maker at
any point in the project review process; and
WHEREAS, the Director of Community Development transferred original hearing jurisdiction to
the Planning Commission at his discretion because of policy implications and unique or unusual
circumstances; and
WHEREAS, the Planning Commission did hold a Public Hearing on said project application on
July 12,2005; and
WHEREAS, proper notice of said Public Hearing was given in all respects as required by law;
and
WHEREAS, a Public Hearing Notice was mailed to all adjacent property owners and tenants
within 500 feet of the project site; and
WHEREAS, a Staff Report was submitted to the Planning Commission recommending denial of
said application; and

WHEREAS, the Planning Commission did hear and use their independent judgment and
considered all said reports, recommendations, and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Planning Commission of the City of
Dublin does hereby make the following findings and determinations regarding said Site Development
Review:
A. Approval of this application would not be consistent with all requirements of the Zoning
Ordinance as Section 8.92.030.C prohibits wireless communication facilities on private property
within residential zoning districts and the project site is located on private property within an R-l,
Single Family Residential zoning district.

Dear City of Dublin:
I reside at 7961 Shannon Court. My house is literally behind St. Raymond's steeple. It is my understanding
from the public notice you sent out that St. Raymond's and the city are considering erecting a wireless
telecommunications facility in the steeple.
I would like you to consider not doing this. As a parent to three children who also reside at the above
address I believe that our quality of life will be severely diminished. Studies have not been conclusive on the
health risks posed to the community from such actions. I am not willing to have my family be guinea pigs for
the benefit of St. Raymond's.
It is my understanding that facilities such as the one being considered cannot be located in a residential area
or on privately owned land. Is St. Raymond's not on private property and located in a residential area? I invite
you to come to my house and see how close we are to the proposed area.
Also it is my belief that St. Raymond's was supposed to contact us with their intentions. They have not. The
only reason I know about this proposal is because the city sent out the notice. I do not believe that St.
Raymond's is acting in the best interest of their neighbors, the children in their school and their parishioners.
I urge you to reconsider letting the church move forward with their request. Please feel free to come into our
neighborhood and talk with my neighbors and see exactly how close the antenna/steeple is located to my yard.
