HomeMy WebLinkAbout11-28-1988REGULAR MEETING - November 28, 1988 A regular meeting of the City Council of the City of Dublin was held on Monday, November 28, 1988, in the meeting room of the Dublin Library. The meeting was called to order at 7:35 p.m., by Mayor Linda Jeffery. ROLL CALL PRESENT- Jeffery. Councilmembers Hegarty, Moffatt, Snyder, Vonheeder and Mayor PLEDGE OF ALLEGIANCE The Mayor led the Council, Staff and those present in the pledge of allegiance to the flag. CERTIFICATION OF ELECTION RESULTS City Clerk Richard Ambrose advised that the City has received the Certif- ication of Election results dated November 23, 1988, from the Alameda County Registrar of Voters. The Board of Supervisors will officially approve the Certification at its meeting of December 6, 1988. Out of 10,106 registered voters, a total of 7,690 votes were cast for the office of Member, City Council. On motion of Cm. Hegarty, seconded by Cm. Moffatt, and by unanimous vote, the Council adopted RESOLUTION NO. 146 - 88 RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 1988, DECLARING THE RESULTS THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW ADMINISTER OATH OF OFFICE TO NEWLY ELECTED COUNCILMEMBERS City Clerk Richard Ambrose administered the Oath of Office to Linda J. Jeffery and Peter W. Snyder, newly elected Councilmembers. REORGANIZATION OF COUNCIL FOLLOWING ELECTION City Clerk Richard Ambrose advised that Government Code SectiOn 36801 requires the City Council to meet after a General Municipal Election to choose one of its number as Mayor and one as Vice Mayor. In November, 1986, the City Council unanimously established a policy whereby a bi-annual election of Mayor and Vice Mayor will occur following the election with annual reconfirmations. Mr. Ambrose advised that nominations are to be made by an open ballot. Cm. Moffatt asked if Roberts Rules of Order would be used. City Attorney Nave advised that they would be used. Cm. Hegarty nominated Cm. Moffatt for Mayor and called for nominations to be closed. Cm. Vonheeder seconded the motion, and by a unanimous vote, Paul Moffatt was selected to serve as Mayor. Cm. Jeffery thanked the City Council for the opportunity to serve as Mayor for the past 2 years. Cm. Hegarty indicated that he thought that Linda Jeffery had done a marvelous job as Mayor. The City has progressed in a smooth fashion. A lot depends on the cooperation of City 'Staff and other members of the City Council. He felt that Paul Moffatt will now take over and carry on in a good manner. Mayor Moffatt thanked the Councilmembers for their support. He felt that anyone can only be as good as those who stand behind themand support them. Mayor Moffatt stated that he felt that both Pete Snyder and Linda JefferY did an excellent job as Mayor and he looked forward to continuing in the same manner and doing the best he can. ************************************************************************* CM-7-344 Regular Meeting November 28, 1988 Mayor Moffatt declared nominations open for the position of Vice Mayor. Cm. Snyder nominated Cm. Hegarty. Cm. Hegarty indicated that his time will not permit him to attend necessary functions in the absence of the Mayor, and he respectfully declined the nomination. Cm. Snyder withdrew the nomination. Cm. Hegarty nominated Cm. Vonheeder and Cm. Jeffery nominated Cm. Snyder. On motion of Cm. Jeffery, seconded by Cm. Hegarty, and by unanimous vote, the nominations were closed. Cm. Snyder received 2 votes, Cm. Vonheeder received 3 votes. Cm. Vonheeder was declared Vice Mayor. Mayor Moffatt asked if anyone wished to discuss committee assignments or make any changes. City Manager Ambrose advised that Staff could bring back a current list of committee assignments at the next meeting if the Council so desired. By a consensus of the Council, since no one desired to make a change, the matter was dropped. Dublin Boulevard/Silvergate Drive Intersection Dave Burton, Dillon Way, offered his congratulations to Mayor Moffatt and Vice Mayor Vonheeder. Mr. Burton advised that several months ago, he brought to the Council's attention a concern related to the berm on Dublin Boulevard as it curves into Silvergate Drive. The pedestrian area gets very narrow and there is no sidewalk. He suggested that the berm be moved out to where the white line is. City Engineer Lee Thompson advised that this area has been monitored for several years and it appears that some major work needs to be done soon. If the Hansen Hill proposal is approved, this intersection will be redone. Mr. Thompson advised that he will get back to the Council with some cost estimates for improvements. CONSENT CALENDAR On motion of Cm. Jeffery, seconded by Cm. Vonheeder, and by unanimous vote, the Council took the following actions: Approved Minutes of Regular Meeting of November 14, 1988; Adopted RESOLUTION NO. 147 - 88 DESIGNATING SAN RAMON ROAD AT VOMAC ROAD/WEST VOMAC ROAD AS A SIGNALIZED INTERSECTION ************************************************************************* CM-7-345 Regular Meeting November 28, 1988 Adopted RESOLUTION NO. 148 - 88 AMENDING THE MEMO~~ OF UNDERSTANDING DATED JULY 15, 1987 REGARDING TRANSFER OF SERVICE RESPONSIBILITY AMONG CITY OF DUBLIN, DUBLIN SAN RAMON SERVICES DISTRICT, AND CITY OF SAN RAMON Accepted Financial Reports for the months of July, August, September and October, 1988; Approved Warrant Register in the amount of $1,150,423.58. PUBLIC HEARING-ESTABLISHMENT OF LOADING ZONE ON DUBLIN COURT & REPEAL OF EXISTING LOADING ZONE AND NO PARKING ZONE FOR TRUCKS OVER 20' IN LENGTH Mayor Moffatt opened the public hearing. City Engineer Thompson advised that the City had received a request from the business owner of Linens Unlimited, 6632 Dublin Boulevard, that a loading zone be established on the north side of Dublin Court so that trucks making deliveries to the business would have adequate parking. Mr. Thompson explained that Dublin Court is a two-lane roadway which is commercial in nature. The road curves and connects with Dublin Boulevard near the rear door of Linens Unlimited. On-street parking is presently allowed on both sides of Dublin Court, except for an existing loading zone on the north side at the opposite end of the building from Linens Unlimited. The Vehicle Code states that a commercial vehicle is allowed to double park in order to unload freight if curb space is not available, and in fact, trucks do this in order to deliver to Linens Unlimited. Because of the concrete median and the curve in the road, it is not safe for other traffic to pass a truck that is double-parked. On-street parking is primarily used by employees and customers of Crossroads Pontiac-Toyota. The proposed loading zone is 60', which equals approximately 3 parking spaces. The existing loading zone at the opposite end of the building was originally established as a Greyhound bus stop; however, the bus does not use the loading zone but simply passes through the parking lot on its way back to the freewaY. Mr. Thompson advised that if it becomes necessary,~ the bus can legally use the adjacent red zone, and by removing the existing yellow zone, no parking spaces are lost. The new loading zone occupies a portion of the curb posted "No Parking fOr Trucks Over 20' in Length", and Staff proposed a repeal of the Ordinance section that established this parking prohibition. The no parking zone for trucks was originally established by the County because of a problem with moving vans and trailers being stored on the street. The Citywide Ordinance prohibiting trucks from parking longer than 2 hours would take care of this situation. *+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+*+* CM-7-346 Regular Meeting November 28, 1988 Staff sent notices to businesses that abut Dublin Court regarding this hearing. No comments were made by members of the public relative to this issue. Mayor Moffatt closed the public hearing. On motion of Cm. Jeffery, seconded by Cm. Vonheeder, and by unanimous vote, the Council waived the reading and adopted on an ur§ency basis~ ORDINANCE NO. 21 - 88 ESTABLISHING A LOADING ZONE, REPEALING AN EXISTING LOADING ZONE, AND REPEALING A NO PARKING ZONE FOR VEHICLES OVER 20' IN LENGTH ON DUBLIN BOULEVARD OTHER BUSINESS Flag Donation to Soroptimists Cm. Jeffery stated that she had received a letter from the Dublin Soroptimists thanking the City Council for their donation of the flag that will fly over the new Civic Center on the first day. Directly Elected Mayor Cm. Snyder indicated that several residents have expressed a desire for Dublin to have a directly elected mayor, and additionally, there was an editorial recently in the Tri-Valley Herald encouraging Dublin to consider this process. Cm. Snyder requested that Staff look into this and bring the issue back to the Council for consideration at a future meeting when it would be convenient to place it on the agenda.
