HomeMy WebLinkAboutReso 149-05 RightOfWayDubFallon RESOLUTION NO. 149 - 05 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ~ * . * * * * * * RESOLUTION OF INTENTION TO ESTABLTSH RIGHT OF WAY LINES FOR DUBLTN BOULEVARD BETWEEN KEEGAN STREET AND FALLON ROAD, AND FOR FALLON ROAD BETWEEN BENT TREE DRIVE AND 1-580 WHEREAS, the City of Dublin has proposed the establishment of right-of-way lines for Dublin Boulevard and Fallon Road in accordance with Municipal Code Chapter 7.68; and WHEREAS, the affected segment of Dublin Boulevard is between Keegan Street and Fallon Road; and WHEREAS, the affected segment of Fallon Road is between Bent Tree Drive and 1-580; and WHEREAS, the proposed right-of-way lines confonn to the lines previously established with the Final Map for Tract 7281 for the northern segment of Fallon Road; and WHEREAS, the project has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and implementing Guidelines, and the Planning Commission adopted a Negative Declaration with Resolution No. 05-32, because the Right of Way Lines do not change the analysis, conclusions, or mitigation measures of the 1993 Eastern Dublin Specific Plan Environmental Impact Report (ElR) and will have no new significant effect on the environment; and WHEREAS, a report and recommendation were prepared on behalf of the Public Works Director and submitted to the Planning Commission, as required by Municipal Code Chapter 7.68, recommending that the Planning Commission recommend to the City Council adoption of a Resolution of Intention to establish right-of-way lines; and WHEREAS, the Planning Commission, after hearing and considering all said reports, recommendations and testimony at a public hearing on May 24, 2005, adopted Resolution No. 05-33, recommending that the City Council adopt a Resolution ofIntention; and WHEREAS, the City Council intends to establish right-of-way lines for Dublin Boulevard and Fallon Road; NOW, THEREFORE, BE IT RESOLVED that the City Council hereby adopts this Resolution of Intention and calls for a public hearing pursuant to Sections 7.68.080 through 7.68.100 of the Dublin Municipal Code, at 7;00 p.m. on July 19, 2005, in the City of Dublin City Counc.il Chambers, 100 Civic Plaza, Dublin, California, to hear protests and objections to the establishment of the proposed right-of-way lines as depicted on the legal descriptions attached hereto as Exhibit" A." BE IT FURTHER RESOLVED that the City Clerk is directed to post this Resolution of Intention in accordance with Section 7.68.070 of the Dublin Municipal Code at least 10 days before the hearing.
