The Applicant, Sandy Hsi, is requesting approval of a Conditional Use Permit for the operation of a Christian pre-school and after-school learning center in an existing educational building of the Parkway Baptist Church located at 7485 Village Parkway. The religious facility is currently operating under a Conditional Use Permit approved in 1965 and amended in 1973. The Conditional Use Permit allows the operation of a church, school and fellowship hall. The new Christian pre-school and after-school learning center will be open to students in the community and regional area. The project site is a large interior lot with single-family homes to the north and east. Village Parkway is located west of the site, with a commercial shopping center located to the south. The property is zoned R- 1Single Family Residential Zoning District, and the General Plan designation is Single-Family Residential. The primary service offered by the Seed2Sprout Learning Center will be daycare services, in conjunction with the secondary use of after-school care and education. Daycare facilities are permitted in R-1 zoning districts with a Conditional Use Permit approved by the Planning Commission under Chapter 8, Section 8.12.050 of the Dublin Zoning Ordinance. ANALYSIS: The existing building to be used for the proposed pre-school and after-school learning center is approximately 6,000 square feet. The learning center will operate exclusively on the first floor of the educational building of the church which consists of approximately 3,000 square feet of area. The second story of the building will be off limits to the students at the learning center and locked at all times. No exterior changes or additions to the building are proposed by the Applicant. Additionally, no tenant improvements to the interior of the building COPIES TO: Applicant Property Owner PA File G:\P,A~\2005\05-020 Seed2Sprout Learning Ctr\PC-sr.doc ITEM NO. _ are proposed for the learning center. The building is located to the east and adjacent to the church sanctuary and fellowship buildings. A fenced and gated play area of approximately 2880 square feet is proposed adjacent to the educational building on land owned by the church and presently covered with grass, low-level vegetation and landscaping. The play area fence will be constructed of five (5) foot chain link fencing with locking gates. Children will be supervised in the play area at all times. The Applicant anticipates an enrollment of 58 children with one (1) teacher for every 12 children. The standard operating hours for the educational facility according to the Applicant's Written Statement in Attachment 2 are Monday through Friday from 7:00 a.m. to 6:00 p.m. when the learning center is in full operation. In the initial phase of the learning center's operation, only part-time daycare and after-school care in the afternoons will be available. Noise Impacts on Neighborhood Staff visited the site and determined that noise impacts to surrounding residences will be minimal as the proposed play area will be fenced and located approximately 42 feet from the property boundary to the east. A dense grove of mature trees is located in front of and adjacent to the fence that surrounds the church property. Additionally, the play area is approximately 115 feet from the commercial development to the south. Noise will be minimized by the learning center operator through limits on the number of children in the play area; the monitoring of the play areas when children are present by teachers at a 1 per 12 children ratio; and through limits on the hours of outdoor play, hours of operation of the learning center, and, hours for pick-up and drop-off. Conditions of Approval are included in the resolution that limit the hours of operation from 7:00 a.m. to 6:00 p.m. Monday through Friday (Condition #3 of the Conditions of Approval in Resolution, Attachment 1). The Conditions further require that noise generated at the site be controlled so as not to create a nuisance to the adjoining residential neighborhood. Outside activities are restricted from taking place before 9:00 a.m. or after 6:00 p.m. (Condition #6). Tra f ac Impacts The City's Traffic Engineer determined that the traffic impacts of the proposed learning center will be minimal, and that no traffic mitigation or Traffic Impact Fee is required. Additionally, traffic to and from the center will be minimized through limits on the number of children in the pre-school and after-school programs, the hours of outdoor play, the use hours and location of the outdoor play area, the hours of operation, and, the hours of pick-up and drop-off as discussed in the Noise Impacts section of this report. Pick-up and drop-off times will be primarily in the weekday morning, early afternoon, and afternoon hours, when other traffic is not using the church driveways. Additionally, parents typically drop-off and pick-up their children at staggered times throughout the morning and late afternoon. The center also accepts students for after-school care programs. Those students will predominantly walk to the center from nearby elementary schools in the late afternoon, thereby reducing vehicle trips during morning peak times. Part-time students are included in the maximum enrolled total of 58 children. Parkin Per the City's Parking Ordinance, the daycare facility for 58 students is required to provide nineteen (19) off-street parking spaces. The nineteen (19) parking spaces are broken into the following categories: 2 Group Parking Requirement Number of Parking Parking Spaces Spaces required Provided Teachers/employees: 1 1 parking space per teacher 5 parking spaces 8 parking spaces teacher per12 students Students: max. 58 1 parking space per 5 12 parking spaces 31 parking spaces children Handicapped: 1 parking space per 24 2 handicap parking 2 handicap parking spaces spaces or fraction there of s aces Total for Use 19 parking spaces 41 parking spaces (22 over requirement) The Applicant's Site Plan (see Exhibit A of Attachment 1) includes thirty-one (31) parking spaces reserved for the drop-off and pick-up of students; eight (8) spaces for the employees; and two (2) handicap parking spaces, for a total count of 41 parking spaces on-site. The school does not yet have a van or bus for transportation of children to events. The church uses only two to three spaces on a daily basis for the minister, maintenance worker and an occasional parishioner or visitor. With a total of 41 parking spaces on-site, the available off-street parking in the parking lot should be sufficient to serve the proposed use, including any drop-offs for the after-school program, and accommodate a van for the learning center (if acquired in the future). The parking lot presently contains one handicap parking space. In accordance with the ADA regulations, the Applicant is required to include another handicap parking space as close to the front walkway as possible. This additional parking space is shown on the Site Plan (Exhibit A of Attachment 1), and also in the diagram on page l0a of the Applicant's Written Statement (Attachment 2). Additionally, a condition has been included in the Conditions of Approval (Condition #20) that the Applicant re-stripe the parking lot area to clearly identify the two handicap parking spaces and delineate all other spaces in the lot. Si,Qnage One sign or bulletin board is proposed for the learning center and will be visible from the street frontage. The signage will be located on the educational building to provide information to visitors, students and parents. The size of the proposed sign is 2 '/z feet by 4 feet, and conforms to the Sign Regulations of the Zoning Ordinance, Chapter 8.84. The Applicant will be required to obtain a building permit prior to installation of the sign on the building (Condition #17). Licensing The Applicant, Sandy Hsi has included a copy of her current license from the State of California Department of Social Services for the operation of apre-school for verification purposes, prior to establishment of the use. In the initial phase of operation of the learning center when students are attending only part-time, the center is exempt from the State licensing requirement under California Community Licensing Title 22 (see page 5 of Attachment 2). At full operation, the Applicant will be required to provide a copy of a valid license for the operation of the learning center. The Conditions of Approval (Condition #25) further require the Applicant, on a continuing basis, to provide the Community Development Department with current and updated Daycare operating licenses issued by the State of California Department of Social Services. Conditional Use Permit Findings Under the State of California Planning Law, a Conditional Use Permit may only be approved and issued if certain findings are made by the approving body. In this case, the Planning Commission is the approving body and must make the findings as listed in the Resolution (Attachment I, pages 1-2}, which have been modified by Staff for the subject project. These findings pertain to the suitability and compatibility of the use with surrounding properties and uses, and the particular zoning district where it is located; the effect of the use on the health, safety and welfare of the surrounding community; and, that adequate public utilities and services are available at the site for the specific use. If the Planning Commission determines that the project meets the findings in the Resolution in Attachment 1, the Resolution should be adopted to approve the Conditional Use Permit for the Seed2Sprout Learning Center, subject to the conditions also listed in the Resolution. Public Noticing A public notice regarding the proposed project was sent to property owners and interested parties within a 300-foot radius of the project site, and delivered to the newspaper with the widest circulation in the Dublin area for publication by July 16, 2005. No comments on the project have been received to date as a result of the notice. ENVIRONMENTAL REVIEW: The California Environmental Quality Act (CEQA), together with the State guidelines and City environmental regulations require that certain projects be reviewed for environmental impacts and environmental documents be prepared. The project has been found to be Categorically Exempt from the provisions of California Environmental Quality Act (CEQA), in accordance with the CEQA Guidelines, Section 15301(Classl) as it is a daycare/educational use located in an existing structure proposed for only minor alterations in the site landscaped area. CONCLUSION: The proposed learning center would have limited impacts to the surrounding neighborhood related to noise, traffic, and parking, and will serve the surrounding community and regional area in providing pre- school and after-school care services for children. The facility will be properly licensed, and no complaints have been received about the existing educational building use during Sunday services. The Conditions of Approval in the Resolution (Attachment 1) will ensure that the use of the religious facility for the learning/educational center will be an asset to the community. RECOMMENDATION: Staff recommends that the Planning Commission: 1) open public hearing and hear Staff presentation; 2) take testimony from the Applicant and the public; 3) close public hearing and deliberate; and, 4) adopt a Resolution (Attachment 1) approving the Conditional Use Permit for PA OS-020, a Christian pre-school and after-school learning center, subject to conditions. 4 GENERAL INFORMATION APPLICANT: Sandy Hsi 6110 Bay Hill Court Dublin, CA 94568 (925) 828-6343 PROPERTY OWNER: Parkway Baptist Church 7485 Village Parkway Dublin, CA 94568 LOCATION: Located at Parkway Baptist Church, 7485 Village Parkway GENERAL PLAN DESIGNATION: Single Family Residential EXISTING ZONING AND LAND USE: R-1 Single-Family Residential Zoning District. The site has been developed as a religious facility complex, with associated structures and paved parking lot areas. 5 RESOLUTION NO. OS - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA OS-020 SEED2SPROUT LEARNING CENTER CONDITIONAL USE PERMIT REQUEST FOR APRE-SCHOOL AND AFTER SCHOOL CARE IN AN EXISTING EDUCATIONAL BUILDING LOCATED AT PARKWAY BAPTIST CHURCH AT 7485 VILLAGE PARKWAY WHEREAS, Sandy Hsi has submitted an application to request approval of a Conditional Use Permit for the operation of apre-school and after school learning/education center, for a maximum of 58 children, as the primary use within an existing educational building in a R-1 Single Family Residential Zoning District, located at 7485 Village Parkway; and WHEREAS, the Planning Commission conducted a public hearing on July 26, 2005 to consider said application; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and this project was found to be exempt under the CEQA Guidelines Section as it is a comparable use in an existing building which requires no alteration. The landscaping in the rear yard of the facility will be modified to include play areas for students and will have no significant effect on the environment; and WHEREAS, the Planning Commission considered all testimony received at the public hearing, together with the Agenda Statement and all correspondence received at the July 26, 2005 public hearing; and WHEREAS, the Planning Commission approves the Applicant's request for the Conditional Use Permit, PA OS-020, subject to conditions of approval set forth below. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed operation of the pre-school and after school learning/education center is compatible, as conditioned, with other land uses, transportation and service facilities in the vicinity because noise and traffic impacts will be minimized through limits on the number of children, the hours of outdoor play, the use hours and location of the outdoor play area, the hours of operation, and the hours of pick-up and drop-off. B. The use, as conditioned, will not adversely affect the health or safety of persons residing or working in the vicinity, or be detrimental to the public health, safety and welfare because all local and State regulations will be met. ~`~'I'A~~I~~~~' ~-- C. The use as conditioned, will not be injurious to property or improvements in the neighborhood because the proposed learning center will minimize noise impacts and traffic impacts through limits on the number of children, the use hours and location of the outdoor play area, the hours of operation, and the hours of pick-up and drop-off. D. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use and related structures would not be detrimental to the public health, safety, and welfare. E. The subject site is physically suitable for the learning/educational center and school use, density and intensity of the use, and the related activities being proposed as it will be located in an existing education building at a local religious facility. F. The Seed2Sprout Learning Center, as conditioned, is not contrary to the specific intent clauses, development regulations, or performance standards established for the zoning district in which it is located because it is a residential use and provides a needed quasi-public, community service. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby approve PA OS-020 Seed2Sprout Learning Center Conditional Use Permit application as generally depicted by the Applicant's written statement and materials labeled Exhibit A, stamped approved and on file with the Dublin Planning Division of the Community Development Department, subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise all Conditions of Approval shall be complied with~rior to occupanc o educational building and establishment of use (having_more than 12 children in the learning center), and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval. This Conditional Use Permit approval for PA OS-020 is to allow the operation of a Christian pre-school and after school learning/educational facility at 7485 Village Parkway in a PD Single Family Residential Zoning District. This approval. shall generally conform to the Applicant's written statement and plans stamped approved, labeled Exhibit A, consisting of a Site Plan and Floor Plan stamped received by the Planning Division on June 16, 2005, and shall be subject to the following conditions. CONDITION RESPON PARTY WHEN GENERAL 1. Compliance with Regulations. This use shall comply with all [PL] On-going applicable Planning, Building, Alameda County Fire Department, Police Department, Dublin San Ramon Services District and State of California Department of Social Services regulations and ordinances. 2 CONDITION RESPON WHEN PARTY 2 Maximum Number of Children. The maximum number of [PL] On-going children present at the day care facility at any one time shall not exceed 58 children. 3 Hours of Operation. The learning/educational center shall operate [PL] On-going Monday through Friday between the hours of 7:00 a.m. and 6:00 p.m., and shall be closed on the weekends. The learning/educational center shall generally have drop-off times from 7:00 a.m. to 9:30 a.m. and pick-up times between 3:30 .m. and 6:00 p.m. 4. Modifications to Building. No modifications to the educational [PL] On-going building at the Parkway Baptist Church are proposed with this project. No future modifications to the building may occur unless an application for an amendment to the Conditional Use Permit is submitted and approved, if applicable, and/or Building Permits are ap lied for and ap roved. 5. Limitation on Building Use. The pre-school and after-school [PL] On-going childcare shall be limited to the first floor of the educational building. The second floor of the building shall be secured and locked at all times to revent children from entering the upper level. 6. Noise. Noise generated at the site shall be controlled so as not to [PL] On-going create a nuisance to the adjoining residential neighborhood. Outdoor activities in the play area and east of the educational building are restricted from taking lace before 9:00 a.m. or after 6:00 p.m. BUILDING 7. Building Codes and Ordinances. Any project construction shall [B] Through Completion conform to all building codes and ordinances in effect at the time of building permit. 8. Building Permits. To apply for building permits, [B] Issuance of Building Applicant/Developer shall submit eight (8) sets of construction Permits plans to the Building Division for plan check. Each set of plans shall have attached an annotated copy of these Conditions of Approval. The notations shall clearly indicate how all Conditions of Approval will or have been complied with. Construction plans will not be accepted without the annotated resolutions attached to each set of plans. Applicant/Developer will be responsible for obtaining the approvals of all participation non-City agencies prior to the issuance of building permits. 9. Construction Drawings. No other Signage, except for directional [PL] On-going Signage in the parking lot area for the church, in accordance with Chapter 8.84 of the Dublin Zoning Ordinance, shall be permitted without submittal and approval of an application for Sign/Site Development Review. 18 Play Area. The play area shall be located in the lawn area adjacent [PL] On-going to the educational building to be used as the learning center. This area shall be fenced and gated as stated in Condition #23, improved as indicated on Exhibit A, and maintained in a manner to ensure the health and safety of the students. The area shall not be enlarged unless Site Development Review is reviewed and approved by the Community Development Director and all other conditions herein have been met. PARKING 19 Parking. Parking shall be provided as shown on Exhibit A in the [PW] On-going existing church parking lot. Facility staff and those vehicles dropping off students shall park in the parking lot spaces for the use as shown on Site Plan for the facility. Clients may not park along Village Parkway to dro -off students for safety purposes. CONDITION RESPON WHEN PARTY 20 Re-striping of Parking Lot. The Applicant shall be responsible [PW] Prior to Occupancy for the restriping of the parking lot area All parking spaces shall be double striped using 4" white lines set approximately 2 feet apart according to Figure 76-3 and §8.76.070 (A) 17 of the Dublin Municipal Code. All compact-sized parking spaces shall have the word "COMPACT" stenciled on the pavement within each space. 12"-wide concrete step-out curbs shall be constructed at each parking space where one or both sides abuts a landscaped area or planter. 21 Handicap Parking Spaces. A total of two handicap parking spaces are required for the use. 22 Vehicle Access. The main driveway entry from Village Parkway to [PW] On-going the religious facility shall be used as the accessway to the parking lot for the learnin education center. 23 Outdoor Play Area. Outdoor play activities shall be limited to the [F, Pl] Prior to permitting 2,880 square foot area as shown on the Floor Plan in Exhibit A, outdoor play on site which shall be fenced and contain locking gates for security purposes. 24 Pick-up of Children. The operator of the learning/educational [P, PL] On-going center shall require that children remain either inside the Center or in the outdoor lay area for pick-up by their parent or guardian. LI CENSING & CERTIFICATION 25 Valid License. Prior to the establishment of this use, the operator [P, PL] On-going shall submit a copy of the valid State Department of Social Services License Permit for the operation of the learning/educational center, if applicable. 26 Continued License Compliance. On a continuous basis, the [PL] On-going Applicant shall provide the City of Dublin Community Development Department with a current operating license issued by the State of California Department of Social Services, as a licable. 27 Abuse Prevention Program. The learning/educational center [P, PL] On-going director shall, at the minimum of a once-a-year basis, make arrangements to have the Dublin Police Services Child Abuse Prevention Program, or an acceptable equivalent program approved by Dublin Police Services, presented to the Staff and children attending the facility. A certification of the presentation of such a program shall be presented to the Planning Department on a yearly basis. FI RE DEPARTMENT CONDITIONS 28 Exit Signage. Illuminated exits and exit signs are required. [F] Prior to Occupancy CONDITION RESPON WHEN PARTY 29 Exit Hardware. Exit doors must be operable from the inside [F] On-going without special knowledge or the use of a key. Slide locks, chains, etc. are not allowed. Fire Alarm Device is to be mounted to the structure and shall be audible throughout the structure. 33 Fire Extinguishers. Fire Extinguishers are required in the [F] Prior to Occupancy playroom adjacent to the garage and in the kitchen due to the floor lan. 30 On-Site Fire Inspection. An on-site inspection is required prior to [F] Prior to Occupancy Fire Department final approval of the facility. The inspection fee is $80.00. State Licensing also requires the ins ection. ADDITIONAL PLANNING CONDITIONS 31 Establishment of Use. This approval shall be null and void in the [PL] On-going event the approved use fails to be established within one year, or ceases to operate for a continuous one-year eriod. 32 Cleanup and Disposal of Trash. The Applicant shall be [PL, PW] On-going responsible for cleanup and disposal of project related trash in order to maintain a clean and litter free site. 33 Revocability. At any time during the effectiveness of this approval, [PL] On-going the approval shall be revocable for cause in accordance with Section 8.96.020.I of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this ermit shall be subject to citation. PUBLIC WORKS CONDITIONS 34 Title Report. A current preliminary title report (not more than 6 [PW] Prior to approval of months old as of date of submittal) together with copies of all improvement plans recorded deeds, easements and other encumbrances and copies of Final Maps for adjoining properties and off-site easements shall be submitted for reference as deemed necessary by the City Engineer/Director of Public Works. 35 Standard Public Works Conditions of Approval. [PW] Prior to approval of Applicant/Developer shall comply with all applicable City of improvement plans Dublin Public Works Standard Conditions of Approval. In the event of a conflict between the Public Works Standard Conditions of Approval and these Conditions, these Conditions shall prevail. CONDITION RESPON WHEN PARTY 36 Harmless/Indemnification. The Applicant/Developer shall defend, [PW] Prior to approval of indemnify, and hold harmless the City of Dublin and its agents, improvement plans and employees from any claim, action, or proceeding against the City of Dublin or its agents, officers, or employees to attack, set aside, void, or annul an approval of the City of Dublin or its advisory agency, appeal board, Planning Commission, City Council, Community Development Director, Zoning Administrator, or any other department, committee, or agency of the City to the extent such actions are brought within the time period required by Government Code Section 66499.37 or other applicable law; provided, however, that The Developer's duty to so defend, indemnify, and hold harmless shall be subject to the City's promptly notifying The Developer of any said claim, action, or proceeding and the City's full cooperation in the defense of such actions or proceedings. 37 Improvement and Grading Plans. All improvement and grading [PW] Prior to approval of plans for play areas, if required, shall be submitted to the Public improvement plans Works Department for review/approval and shall be prepared in accordance with the approved preliminary plan, these Conditions of Approval, and the City of Dublin Municipal Code including Chapter 7.16 (Grading Ordinance). When submitting plans for review/approval, the Applicant/Developer shall also fill-out and submit a City of Dublin Improvement Plan Review Checklist (three 8-1/2" x 11"pages). Said checklist includes necessary design criteria and other pertinent information to assure that plans are submitted in accordance with established City standards. What type of business, activity or use are you proposing? Seed2Sprout Learning Center is a new childcare center, offering ayear-round high-quality Christian Preschool (for 2 years and 9 months old to first-grade entry children }and After- school Educational Enrichment Program (for K-5"' grade children). The learning center provides a unique well-balanced whole-child developmental education in Christian environment. The target opening date is September 1, 2005. Legal, Licensing Seed2Sprout Learning Center was registered as a profitable S-Corporation in California State on June 17, 2004. Currently, the center is in the process of applying for a nonprofit organization status. The business will operate in two progressive phases. In the initial phase, the center provides two sessions of half-day preschool (AM Preschool and PM Preschool} and one session of K- 5after-school enrichment program, Monday through Friday. It has less than 12 hours per week for each preschool program and 15 hours per week for K-5 after-school program. When there is no school or when there is a minimum day at the public elementary schools, the center provides an extended child care program for enrolled K-5 grade children. With these limited hours in the initial phase, the learning center is fully compliant to the regulation of Exemption of the California Community Care Licensure, Title ~2, Division 12, Session 101158. In the second phase, the learning center wiN comple#e the installation of a fenced outdoor playground, and apply for the California Community Child Care State License. The proposed site is the first floor of Education Building, Parkway Baptist Church. It has a 3000 squared feet space, including 3 bathrooms with 7 stalls and 5 sinks, and a kitchen. The indoor space for children's activities is approximately 2000 squared-feet. The proposed outdoor playground is 3600 squared feet. There are 35 parking stalls and one handicap parking stall on the site. The owner (Parkway Baptist Church) does not have any activity during the business hours of the teaming center. A copy of the verification letter from the owner about their operation hours is attached in this documentation. Per California state community license regulation, the maximum capacity at this proposed site is 57 students at any time of the day. There will be 4-8 staff members on site at all times. C. He said that the building construction could be a "Type 5A, and it may be OK to run a childcare business. B.. Sprinkler System: None. It was not required in 157.2 when the building was built. We request that this be exempted. C. Calculation of the occupancy for the area of work and the second floor The center uses the first floor on weekday daytimes only. The church does not use any part of the building at all during the center's operation hours, and there is no church activity on weekday daytime (except that church pastor works in his office at the Main Chapel building}; therefore we only calculate the occupancy for the 1~ floor space of Education Building. The first floor has 3000 squared feet (75 feet by 40 feet} space. This building has 3 restroams: a men's restroom with 3 water closets and 2 lavatories, a women's restroom with 3 water closets and 2 lavatories, and a restroom with 1 water closet and 1 lavatory. Excluding the bathrooms, office, and kitchen, children indoor activity space is about 2000 square fee# space for children activities. Acxrording to California State Community Care Licensing, Division 12, Chapter 1, paragraph 101238.3, the childcare center indoor activity space is 35 square feet per child. Therefore, the maximum capacity of students is 57 children at any session of the day. With this maximum children's capacity and keeping at least 1:12 teacher-children ratio, we will have of 5 teachers (at least) on site. All children and adults will enter and exit from the front (unless for the emergency) . B. The playground is on the right side of the building (not in the back) and is far away from the neighbors and street. C. This must be an exciting opportunity for you and it is for the City of Dublin as well as we recently recognized the importance and need for more semi-public facilities, such as day care centers, within our community. The property at 7485 Village Parkway (Enclosure 1) is located within an R-1, Single Family Residential Zoning District and is currently occupied by Parkway Baptist Church. A Conditional Use Permit was approved in 1965 and 1973 for this property and allows the operation of a church, school, and fellowship hall (Enclosure 2}. Concurrently with the 1965 Conditional Use Permit a Variance was also granted to reduce the required number of off-street parking spaces for all uses from 65 spaces to 35 spaces (Enclosure 3). The granting of the Variance is contingent upon the fellowship hall not being used concurrently with other facilities of the church. Based on the description of your business that you provided to me in previous conversations, it appears that your business more closely resembles what we consider to be a Day Care Center rather than a Commercial School. As such, Day Caze Centers located in an R-1, Single Family Residential Zoning District require approval of a Conditional Use Permit by the Planning Commission. If the nature of your business is not day caze but rather apre-school then it would be considered a Commercial School and would not be allowed in the R-1 Zoning District. Because your program includes children between 2 years of age and 5th grade it appears that the use is more comparable to a Day Care Center.
