No additional costs will be incurred. DESCRIPTION: This is the second reading of an ordinance that was introduced at the November 6th City Council meeting. The shopping center management requested that a section which provided that these spaces would be towaway zones be deleted from the draft ordinance and also requested that a clause be added which would allow the shopping center to convert the spaces to customer parking by providing written notice to the City. Both of those changes were incorporated into the ordinance at the November 64 meeting. At the time that the Regal Theater opened, Staff requested that Hacienda Crossings make several striping and signing changes related to traffic flow and safety Within the shopping center. At the same time, three parking spaces were identified and marked specifically for police vehicles. While a police vehicle can legally park in areas that: would be No Parking Zones for other drivers, these spaces enable the police to COPIES TO: Tracy DeGiuli Botta, RREEF g:\agenmisc\police parking park conveniently and without obstructing other traffic. For situations in which a person may be arrested, Police Services would also prefer to park near the arrest location so that the person does not have to be escorted a long distance to the vehicle. Police personnel have noted that periodically someone will park in one of the designated police spaces, typically when the parking lot is crowded. The City Council previously adopted resolutions which allow enforcement of the Vehicle Code within Hacienda Crossings; however, enforcement of restricted parking spaces was not included in the scope of the resolutions. The draft ordinance would permit police personnel to issue citations to civilian vehicles found parked in a designated police space. Staff feels that public safety within the center is improved by having these spaces readily available. As noted above, RREEF, the firm which manages the shopping center, provided written concurrence with this ordinance but subsequently requested the two changes which were made at the November 6th meeting. Enforcement will be by means of citations only, and the shopping center management will have the ability to rescind the ordinance in the future by providing written notice to the City. Staff recommends that the City Council conduct a public hearing, deliberate, waive the reading, and adopt the ordinance. Page 2 ORDINANCE NO. -01 AN ORDINANCE OF THE CITY OF DUBLIN ESTABLISHING POLICE PARKING SPACES AT HACIENDA CROSSINGS. SHOPPING CENTER The City Council of the City of Dublin does ordain as follows: Section 1: Pursuant to City of Dublin Municipal Code Section 6.04.250, et. seq., and in the interest of public safety, three parking spaces within the Hacienda Crossings shopping center shall be posted as designated police parking spaces, for the use of City of Dublin Police vehicles only, said spaces as indicated on the location map, Exhibit A, attached hereto. Section 2: Said spaces shall be included in Section 6.28.010 (No Parking Zones) of the City of Dublin Traffic Code. Section 3: This ordinance shall become effective 30 days after its final passage and adoption by the City Council. The City Clerk of the City of Dublin shall cause this ordinance to be posted in at least three (3) public places in the City of Dublin in accordance with Section 36933 of the Government Code of the State of California. Section 4: This ordinance shall be of no force or effect upon the receipt by the City Clerk of written notice from the owner of the property in the Hacienda Crossings Shopping Center where the three spaces are located that such owner intends to convert such spaces to customer parking.
