record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with
State Law, no action or discussion may take place on any item not appearing on the
posted agenda. The Commission may respond to statements made or questions asked,
or may request Staff to report back at a future meeting concerning the matter. Any
member of the public may contact the Recording Secretary’s Office related to the proper
procedure to place an item on a future Heritage & Cultural Arts Commission agenda.
The exceptions under which the Commission MAY discuss and/or take action on items
not appearing on the agenda are contained in Government Code Section
54954.2(b)(1)(2)(3).

4.1 Avalon West/St. Patrick’s Way – Public Art
The Heritage and Cultural Arts Commission will reconsider the Public Art proposal
for the Avalon West/St. Patrick’s Way Development Project that is now under
construction. The proposed artwork, adjacent to a new residential building, would
parallel the north side of St. Patrick’s Way, between Golden Gate Drive and Regional
Street.
STAFF RECOMMENDATION:
Reconsider the Heritage & Cultural Arts Commissions previous recommendation not to
consider the Public Art proposal, review a more detailed Public Art proposal, provide
feedback, and recommend the City Council approve the Public Art proposal by Avalon
Bay Communities. The proposed artwork would be adjacent to a new residential building
along St. Patrick’s Way between Golden Gate Drive and Regional Street.

4.2 Little Library Temporary Public Art Program – Naming Tyler Phillips, Recreation Supervisor presented the potential names for the Little Library Temporary Public Art Program. The Commission gave feedback on potential names, discussed the editing of current names, suggested additional names, and suggested adding a location. The recommendation was made that Staff add a Little Library at the Camp Parks History Center to the plans. Commissioner, Steve Minniear, motioned to recommend the name “Go, Park, Read!” to Council.

Parks and Community Services Director, Jackie Dwyer, gave a presentation on the Draft Cultural Arts Center business plan.Public comment was received from Vanessa Thomas providing feedback regardingfine art and the exhibition space. DESCRIPTION:BackgroundAt its November 10, 2022,meeting, the Heritage and Cultural Arts Commission (Commission) reviewed a Public Art project proposal by Developer Avalon Bay Communities (Developer)and Artist Norie Sato (Artist).A copy of that Staff report,with a full project description, is included inAttachment 1. At the meeting, the Commission voted unanimously not to recommend the project for consideration to the City Council. Basis of Vote

The following summarizes the Commission’s concerns and the basis on which the Commission voted not to recommend the project:
Uncertainty of future downtown development adjacent to the proposed project location
Potential security concerns that may arise from the proposed project
Lack of clarity on the goals the Developer and City have for this project
Inability to visualize the proposed project and coinciding site improvementsBased on this feedback, Staff requests the Commission reconsider its original vote and ask City Staff and the Developer to address each bullet point/concern. Then, following further input, the Commission will consider a final recommendation to City Council. Goals, Strategies, and Criteria for Public ArtPer the City’s Adopted Public Art Master Plan, the following should be considered when reviewingpublic art projects:
Projects should enhance pedestrian-friendly public spaces such as parks, plazas, pathways, parking lots, and other places people travel or gather.
Projects should strengthen the unique character of individual neighborhoods, districts, and transit corridors.
Projects integrated into the City’s built environment should be considered, including signage, gateways, sidewalks, crosswalks, bollards, and other public amenities.
Focus project efforts on Downtown Dublin, inclusive of lighted pieces and artistic benches and seat walls. Additionally, when reviewing site-specific public art proposals, the following criteria should be utilized by the Commission:
Does the project further the mission and goals of the Public Art Program?
Does the artwork assist with implementing the goals of the overall project?
Is the artwork integrated with the overall design of the project?
Does the project demonstrate a high level of design quality and integrity?
Can the artwork be maintained within reasonable effort and expense?
Is the proposal an original piece of the highest quality, including design and selected materials?
Is the artwork appropriate in scale, material, form, and content to the immediate social and physical environments?
Is the artwork designed by a professional artist and of the utmost permanence?
In addition to aesthetics, does the artwork serve to establish focal points; terminate areas; modify, enhance, or define specific spaces; establish an identity; or address specific urban design issues?
Does the artwork raise concerns about public liability or appropriateness in the context of community values and/or social norms? Additionally, eligible artworks may be sculptures, murals, and mixed or other media. Artworks

may be functional, including but not limited to gates, railings, seating, shade structures, and streetlights. Infrastructure and other architectural elements may also be considered if created by a professional artist.Reconsideration and Next StepsBased on initial Commission feedback, Staff has addressed these concerns internally and with the Developer. While none of these concerns have resulted in a redesign of the proposed artwork, theywere taken into consideration, and City Staff and the Developer are prepared to share their findings with the Commission.
Concern #1 Uncertainty of future downtown development adjacent to the proposed projectlocationIn coordination with Economic and Community Development, Staff does not expect conflict with future projects in the short or mid-term. The Avalon West project is surrounded by the existing shopping center to the north, a future 113-unit senior residential project to the west, and Connelly Station, as well as a future 300-unit residential project to the east. These planned development projects will benefit from the extension of St. Patrick’s Way and the community gathering space the new street will provide. The adjacent shopping center continues to be improved with a recent proposal by H-Mart to occupy the commercial storefront formerly occupied by Orchard Supply Hardware. Should redevelopment of the shopping center occur in the future, the artwork could be modified, relocated, or completely decommissioned and a new piece installed elsewhere. Any future modifications to the artwork would be returned to the Commission for consideration.
Concern #2 Potential security concerns that may arise from the proposed projectStaff believes that the roadway, landscaping, and other pedestrian-friendly improvements,including decorative light poles, string lights, a variety of seating options, and entry monuments, required as part of the improvement of St. Patrick Way, will bring more traffic and visibility to the project site, thus reducing unwelcomed activity in an area that was previously secluded. The proposed artwork will also enhance the lighting by includingcolumns and decorative pathway lights. The proposed artwork is transparent, comprising perforated metal panels with several gaps in selected areas. Additionally, Staff has conducted site visits in the evening, and adequate security lighting along the rear of the shopping center building(s) is operational and used by the adjacent property owner. Lastly, the artwork was presented to Dublin Police Services for review, and no concerns were noted.
Concern #3 Lack of clarity on the goals the Developer and City have for this projectBefore the Developer approached the City with the proposed artwork, there were previously planned improvements making the project site a future civic gathering space. This included a seat wall, electrical infrastructure, overhead lighting, entry monuments, safety bollards, and contrasting crosswalks that helped create a sense of place. The City has envisioned this area as a location for future downtown events and entered into an agreement with the Developer to ensure that these desired improvements come to fruition. In coordination with the artist, the Developer has added another element to enhance this vision further.

Concern #4 Inability to visualize the proposed project and coinciding site improvementsThis is a unique type of project that the Commission has not been presented with before, including a new street, sidewalk, and landscaping that is non-existent. In the full detailed artwork proposal, which is included in Attachment 2, further details, including site plans and renderings, have been included to further clarify the project being presented. While there is a subjective element related to the aesthetics of public art projects, Staff finds this project meets the criteria that guide the implementation of the City’s Public Art program. This includes enhancing pedestrian-friendly places, incorporating artwork into the built environment, and strengthening the character of the downtown corridor and neighborhood.

STAFF RECOMMENDATION:Recommend to the City Council to approve the Public Art proposal by Avalon Bay Communities for the artwork adjacent to a new residential building along St. Patrick’s Way between Golden Gate Drive and Regional Street.
FINANCIAL IMPACT:There is no impact on the City’s general or public art fund. The project is funded entirely by the developer.
DESCRIPTION:BackgroundAt its May 1, 2018, meeting, the Dublin City Council adopted Resolutions 40-18 and 41-18, authorizing the development of an 8.53-acre site within Downtown Dublin, the construction and extension of St. Patrick’s Way, and the construction of a residential building. More specifically, theproject includes demolishing an existing 204,000-square-foot warehouse building and constructing a 499-unit apartment complex. It also extends St. Patrick’s Way to make it continuous between Regional St. and Amador Plaza Road. Artist Selection

Avalon Bay Communities hired a Public Art Consultant to assist with developing and managing the Public Art component of the project. The consultant assisted with identifying potential sites for the artwork(s) and the development of a curatorial statement and scope. Based on this, artist research was conducted to develop a pool of fifteen artists that could be presented to the developer for review and selection. The artist’s experience, mediums used, geography, and fit within the established curatorial and scope criteria were considered. Following a review of artists, three semi-finalist artists were selected to develop site-specific proposals. Following a review of site-specific proposals and artist interviews, artist Norie Sato and the proposal “ACROSSROADSACROSS”was selected as the desired artwork. Design Proposal“ACROSSROADSACROSS” is a series of approximately 140 painted aluminum panels that span approximately 300ft along St. Patrick’s Way in Downtown Dublin. The panels are between 5ft and 7ft high, on top of an 18-inch-tall seating wall, making the total height approximately 6.5ft to 8.5ft tall. The panels, of various radii, shapes, and orientations, are waterjet cut with different patterns that create a moire effect and shifting views as one travel’s the length of the adjacent road or sidewalk. In addition, eleven column lights and three flower lights are incorporated into the project. A detailed proposal is included with this Staff Report as Attachment 1. The vibrant artwork, located parallel to St. Patrick’s Way between Golden Gate Drive and Regional Street, will be in the public right of way. Following Heritage and Cultural Art Commission Review and City Council approval, the City and the Developer would enter into a Public Art Installation and Maintenance Agreement and Long-Term Encroachment Agreement. While the Public Art Installation and Maintenance Agreement is required for all developer initiated Public Art Projects, the Long-Term Encroachment Agreement is necessary as the artwork will be installed in the public right-of-way. The developer will maintain ownership and maintenance responsibilities. Community OutreachOn August 25, 2022, the developer attended the Farmers Market at Emerald Glen Park to present the proposal to the community and solicit feedback. Over thirty responses were received, with the community overall supporting the project. One project goal was to help create a sense of place, and comments addressed the impact the artwork would have on the character and feel of the downtown street. Staff Review and Next StepsStaff from the City’s Public Works, Economic Development, Planning, and Parks and Community Services Departments have reviewed the artwork proposal. Staff has no concerns with the proposed artwork’s safety or design and determined that it aligns with the City’s Public Art Master Plan.

The Artwork:
1.A Series of curved painted aluminum panels waterjet cut with various patterns create layering,moire pattern movement and shifting views as one moves along the length of
the road.Depending on the speed and location,different combinations and legibility of various images emerge,disappear,become abstract,pull into focus.These panels will
create the bulk of the screening and a backdrop to the street.The curves soften the effect of the screen,while layering images and allowing interesting juxtapositions between
different panels.
The panels will be created in collaboration with AZahner Company,a fabricator based in Kansas City, using their ImageLinessystem of transforming images into perforations.This
“standardization” allows for a more cost effective methodof producing dynamic and unique image effects.They have a great deal of expertise,capability and options for materials
and other fabrication techniques.I have worked with them on other recent projects and feel them unique-ly well-suited for this project and complexities.
The proposed material is painted aluminum, which will be bent and cut as necessary for structure and attachment.The attachment to the concrete seat-ing wall will be with an
added angle for attachment, which will be mechanical, using expansion anchor fasteners. These will allow for strength,permanence,yet replaceability.
The height of the screens are 5’-7’ X various radii.When placed on an 18”high seating wall,the height of the screens will be at least 6’8”above grade. In the
proposed layout,approximately 140 panels are included.
2.Lighting will be incorporated in 2 ways: A):Cylindrical colums out of the same panel materials and colors with perforated patterns and up lights at bot-tom
B):“Flower”lights are whimsical sculptural interpretations of a flower,continuing the thematic connection emanate light from the “petals”

Lighting elements:
