A regular meeting of the City Council of the City of Dublin was held on
Monday, November 9, 1987 in. the meeting room of the Dublin Library. The
meeting was called to order.at 7:30 p.m., by Mayor Linda Jeffery.
ROLL CALL
PRESENT: Councilmembers Hegarty, Moffatt, Snyder, Vonheeder and Mayor
Jeffery.
PLEDGE OF ALLEGIANCE
The Mayor led the Council, Staff and those present in the pledge of alle-
giance.to the flag.
INTRODUCTION OF NEW EMPLOYEES
Lt. John Severini introduced three new Police Officers who have been assigned
to Dublin by the Alameda County Sheriff's Department. The new officers are
Sgt. Gloria Ramirez, Deputy Jeff Harvey and Deputy Robert Rodrigues.
City Manager Ambrose introduced Debra Farrance, who is working in the
Planning Department as a Clerk Typist/Receptionist. Debra has past
experience with the Dublin San Ramon Services District.
The Council welcomed all the new employees.
CONSENT CALENDAR
On motion of Cm. Hegarty, seconded by Cm. Vonheeder, and by unanimous vote,
the Council took the following actions:
Approved Minutes of Regular Meeting of October 26, 1987;
Accepted the City Treasurer's Investment Report for Period Ending October 31,
1987;
Authorized the Mayor to execute an agreement with R. Lance Company, Inc., for
towing services;

AUTHORIZING ACCESS TO CRIMINAL RECORD INFORMATION
FOR EMPLOYMENT OR LICENSING PURPOSES
Authorized the Mayor to execute an amendment to the Architectural Agreement

Contract and authorized Mayor to execute same.
Mayor Jeffery requested that the item related to the City's appointment to
the Alameda County Mosquito Abatement District be removed from the Consent
Calendar. Mayor Jeffery stated that she wished to personally thank Dr.
Scudder for his service on this Board and also for his willingness to
continue with another term.
On motion of Cm. Hegarty, seconded by Cm. Snyder, and by unanimous vote, the
Council adopted

MAKING AN APPOINTMENT TO THE
ALAMEDA COUNTY MOSQUITO ABATEMENT DISTRICT

PUBLIC HEARING
ORDINANCE ESTABLISHING REQUIREMENTS FOR THE PROTECTION OF WATERCOURSES
Mayor Jeffery opened the public hearing.
This ordinance was introduced at the October 26, 1987, Council meeting, and
is part of the City's Municipal Code update. The purpose of the ordinance is
to safeguard and preserve watercourses, protect lives and property, prevent
damage due to flooding, protect drainage facilities, control erosion and
sedimentation, restrict discharge of polluted materials, and enhance
recreational and beneficial uses of watercourses.
A watercourse is defined as any conduit or appurtenant structure or any
natural or man-made channel through which water flows continuously or
intermittently in a definite direction and course or which is used for the
holding, delay, or storage of water.
The ordinance establishes a permit procedure for work within or near a
watercourse. The City Engineering Staff will be responsible for issuing all
permits except that Zone 7 will issue permits for watercourses accePted and
maintained by Zone 7.

On motion of Cm. Snyder, seconded by Cm. Vonheeder, and by unanimous vote,
the Council waived the reading and adopted
ORDINANCE NO. 52 - 87
ESTABLISHING REQUIREMENTS FOR
PROTECTION OF WATERCOURSES
PUBLIC HEARING
DUBLIN BOULEVARD @ REGIONAL STREET
Mayor Jeffery opened the public hearing.
At Staff's request, TJKM analyzed the need for a third westbound traffic lane
on Dublin Boulevard approaching Regional Street. Chris Kinzel explained that
currently, there are only two westbound lanes on Dublin Boulevard at Regional
Street. The lane nearest the median becomes a "trap" left-turn lane which
widens into two left-turn lanes, while the remaining through lane remains a
through lane.
Congestion in this area'could be alleviated by striping three westbound
through lanes at the approach to Regional Street. The restriping would sig-
nificantly improve congestion because traffic turning left at San Ramon Road
would be able to .utilize two lanes east of Regional Street. There would also
be less conflict between traffic on Dublin Boulevard and vehicles exiting
Mervyn's driveway which might also wish to turn left at San Ramon Road.
Suggested improvements include restriping, signing (including a new mast arm
pole), and addition of new detector loops. The "Wheels" bus stop and a
_..ailbox would need to be relocated. Both LAVTA and the'Post Office have
indicated ability and willingness to relocate.
The on-street parking proposed to be eliminated consists of approximately
four spaces.
Staff anticipated that informal bids would be solicited for the mast arm pole
and electrical work, with the cost estimated at $3,500. City maintenance
personnel would provide the striping, signing, and miscellaneous work at an
estimated cost of $4,500.
Cm. Moffatt felt that since the bus stop was being moved eastward, we might
be inconveniencing some people, perhaps this would be a good time to move
the bus stop down to the Golden Gate Avenue area, closer to the future BART
lot.
Chris Kinzel explained that in the ultimate scheme, all the bus stops will
either be moved or possibly be put into insets in the curb. They feel that
the overall population will be best served by this scenario.
Cm. Moffatt further stated that the purpose of local buses is to make it
convenient for shoppers to be able to take a bus to shop.

City Engineer Lee Thompson indicated that the bus stop is really not being
moved that far. In the past, the City was restricted because of the location
of the BART bus stops.
Cm. Snyder advised that the Wheels bus routes were designed to coordinate
with the BART bus stops and they make a loop for maximum convenience.
No comments were made by members of the public relative to this issue.

On motiOn of Cm. Vonheeder, seconded by Cm. , and by unanimous vote, the
Council waived~the reading and on an urgency basis, adopted
ORDINANCE NO. 53 - 87
ESTABLISHING TRAFFIC REGULATIONS
(Repeal Passenger LOading Zone & Bus Stop & Establish No Parking Zone
on Dublin Boulevard @ Regional Street)
and approved the installation of improvements and authorized a budget
transfer in the amount of $9,000 from the Street Improvement Reserve.
PUBLIC HEARING
ORDINANCE ADOPTING CITY OF DUBLIN TRAFFIC CODE
Mayor Jeffery opened the public hearing.
Staff advised that this ordinance contains a listing of all the traffic
regulations currently in effect. This ordinance and the draft traffic code
are being presented at this time in order to preserve the regulations
currently in effect when the proposed City Traffic Ordinance is adopted. The
ordinance adopting the traffic code must be adopted before the ordinance
relating to traffic Control and traffic restrictions so that the City will
not have a period of time in which traffic regulations are not in effect.
The chapters pertaining to through streets and signalized intersections have
been updated to' add all of the new traffic signals and several new streets.
Over the next several months, Staff will review all the items contained
within the Traffic Code and propose ordinances or resolutions to add or
delete provisions as necessary.
Cm. Moffatt indicated that with regard to bicycle lanes, he notices a lot of
bicyclists around town, particularly in the evening, and a lot of the
bicycles have no lights, thereby creating a dangerous situation.
City Engineer Thompson reported that bicycles are designated as vehicles and
are required to have lights at night.
No comments were made by members of the public relative to this issue.

On motion of Cm. Vonheeder, seconded by Cm. Snyder, and by unanimous vote,
the Council waived the reading and INTRODUCED an ordinance adopting the City
of Dublin Traffic Code.
PUBLIC HEARING
ORDINANCE RELATING TO TRAFFIC CONTROL & TRAFFIC REGULATIONS
Mayor Jeffery opened the public hearing.
Staff advised that this ordinance is part of the City's Municipal Code update
and most of the provisions are basically the same as those of the Alameda
County Ordinance Code which was adopted by reference when the City
incorporated.
This ordinance allows a number of traffic control items, such as stop signs,
yield signs, signalized intersections, and through street's, to be adopted by
resolution rather than by ordinance. The California Vehicle Code (CVC)
specifies whether an item may be adopted by resolution or must be adopted by
ordinance.
Staff advised that the CVC recognizes a bicycle as a vehicle and regulates it
as such. The authority to regulate skateboards is delegated to the loCal
agency, and a skateboard is technically considered to be a pedestrian. This
ordinance is intended to work along with the CVC and does not duplicate any
of the CVC's provisions.
City Engineer Thompson explained some of the differences between the proposed
ordinance and the Alameda County Code. One of the differences is that the
City Manager'is authorized under the proposed ordinance to designate 15' on
either side of a driveway as a no parking, red curb area, when it is needed
for sight distance.
Cm. Hegarty questioned exactly what authority this ordinance would give the
City Manager.
Mayor Jeffery stated she felt that if there were a controversial situation,
it would be brought before the City Council.
Cm. Moffatt indicated that people can always appeal a decision made by the
City Manager to the City Council.
With regard to the section related to funeral processions, Cm. Snyder
questioned the use of the word 'parade' which appears twice in Section 15
City Attorney Nave indicated that this word could be deleted as it is not
necessary to the meaning of the paragraph.

On motion of Cm. Hegarty, seconded by Cm. Vonheeder, and by unanimous vote,
the Council waived the reading and INTRODUCED an ordinance relating to
traffic control and traffic regulations.
PROPOSED LIVERMORE SPHERE OF INFLUENCE
City Manager Ambrose advised that the City of Livermore has submitted a
proposed sphere of influence boundary north of 1-580 and contiguous with the
City of Dublin's current sphere of influence boundary to the Local Agency
Formation Commission. Dublin City Staff and property owners in the area have
concerns regarding the location of the proposed sphere line, because of the
impact on the provision of future services to properties within that area.
Staff has been advised by the Executive Director of LAFCO that the Livermore
sphere proposal probably will not be heard until after the first of the year.
Staff requested that the Council consider an appropriate future sphere line
for the City of Dublin if it is different than the City's present sphere line
and designate a committee of Staff and Council representatives to meet with
the City of Livermore in order to work out our mutual conCerns for the area
in question.
Ted Fairfield addressed the Council and indicated that he was representing
some of the property owners, as well as himself, because he owns property in
the area being discussed. He was representing well over half of the
property. The Doolan Road valley is really an integral part of the estern
Dublin area. He felt there were 3 options available: 1) leave the area as
it is; 2) allow Livermore to absorb the area in its sphere; and 3) make it
part of Dublin's sphere. They prefer to opt for Dublin's sphere. A
compromise would be to leave it open until Dublin is through with its study.
Mayor Jeffery felt there had been some misconceptions related to the boundary
lines.
Cm. Hegarty felt it important that a representative from Engineering be on
the committee.
Cm. Snyder stated that when the original, sphere of influence was adopted, the
original line requested from LAFCO was Collier Canyon Road. The line was
moved back as a matter of compromise. There was a strong feeling at the time
that the Las Positas Valley was becoming very vulnerable, and Supervisor
Exceli was instrumental in moving the line. It was a logical compromise at
that time.
Discussion was held relative to the Triad property. This property has been
annexed to the City of Livermore.
Mayor Jeffery reported that we are looking at the whole area for planning
purposes.

City Manager Ambrose clarified that the role of the committee will not be to
stUdy the situation, but rather to meet with Livermore and try to reach a
compromise that both Cities. can support.
Mr. Ambrose indicated that the General Plan boundaries are not restricted to
the sphere of influence boundaries. We need to look at all the various
impacts that this area will have on Dublin.
On motion of Cm. Hegarty, seconded by Cm. Snyder, and by unanimous vote, the
Council agreed to form a committee consisting of the Mayor, the City
Engineer, the Planning Director and the City Manager to meet with
representatives from the City of Livermore to explain Dublin's position
related to the sphere boundary.
Cm. Hegarty requested that the City Manager keep the Council updated
regarding the meetings.
OTHER BUSINESS
Alameda Coun%yLHousin~_ Authority
Cm. Hegarty reported that he may be unable to attend Alameda County Housing
Authority meetings in the future. It is still up in the air as far as what
his working hours will be.
Mayor Jeffery suggested appointing an alternate.
St.a~..ec0ach' Road Landscaping
cm. Snyder questioned the status of the Stagecoach Road landscaping.
City Engineer Thompson reported that they have been replacing the irrigation
lines and they started spraying the weeds today. They should be hydroseeding
within the next week or so. It is progressing. Staff will be sending a
letter to the homeowners in the area, updating them on the situation.
ADJOURNMENT
There being no further business to come before the Council, the meeting was
adjourned at 8:28 p.m.
